HomeMy WebLinkAbout82-59 - Records DestructionRESOLUTION NO. 82 -59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE DESTRUCTION • OF CERTAIN RECORDS WHEREAS, California Government Code §34090 authorizes the destruction of certain records upon the written consent of the City Attorney, with the approval of the legislative body; and WHEREAS, the Chief of Police of the City of Newport Beach has requested the right to destroy certain City records that take up space and are not of any use, to wit: Personnel Complaints retained in personnel and miscellaneous files which have reached a state of disposition as sustained, not sustained, unfounded or exonerated; and and WHEREAS, all such records are more than five years old; WHEREAS, the City Attorney has consented in writing, to the destruction of these records with the exception of those which could be evidence in any pending claim or litigation filed against the City. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach, does hereby approve of the destruction of those records specified above. Complaints which could be evidence in any pending claims or litigation filed against the City shall not be destroyed even if they exceed five years of age until the claim or litigation is resolved. BE IT FURTHER RESOLVED that this resolution shall take effect immediately; and BE IT FURTHER RESOLVED that the City Clerk shall . certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of the City of Newport Beach, and shall make a record of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same was passed and adopted.
