HomeMy WebLinkAbout82-64 - 21st Place Street Closure FindingsRESOLUTION NO. 82 -64 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SETTING FORTH FINDINGS REGARDING CLOSURE OF 21ST PLACE BETWEEN OCEAN- FRONT AND MCFADDEN PLACE (b: ADJACENT ALLEY) TO VEHICULAR TRAFFIC WHEREAS, on April 26, 1982 the City Council reviewed reports and conducted a public hearing concerning the closure to vehicular traffic of 21st Place between Oceanfront and McFadden Place and 50 feet of an adjacent alley hereinafter referred to as subject street; and WHEREAS, such closure is authorized pursuant to Vehicle Code Section 21101; and WHEREAS, the City Council :heard testimony and received written materials at the noticed public hearing; and WHEREAS, at the conclusion of the hearing, the City Council adopted Resolution No. 82 -58 authorizing closure of 21st Place and part of the adjacent alley as set forth on Exhibit "A" attached hereto; and WHEREAS, at that time, the City Council directed the City Attorney to prepare findings consistent with their decision and the record of subject proceedings. NOW, THEREFORE, the City Council of the City of Newport Beach does hereby incorporate the following as their findings consistent with Resolution No. 82 -58: 1. Closure of subject street will result in no interference with the movement of traffic on surrounding streets. • 2. Subject street is less than a full scale thoroughfare and other streets in the area are available to adequately handle vehicular traffic. 3. Vehicular traffic on subject street is incompatible with the heavy pedestrian use in the area.. 4. Subject street area is routinely used for parking of • commercial vehicles as opposed to through traffic. 5. Substantial ingress and egress for adjoining property owners via subject street is not impaired by closure; and loading zones shall be provided at both ends of 21st Place. 6. The travelling public is not prejudiced by subject street closure. 7. Subject to Resolution No. 82 -58, 21st Place and the adjacent alley (50 ft. of the alley intersecting 21st Place) is not needed for vehicular traffic. ADOPTED this 10th day of May , 1982.
