HomeMy WebLinkAbout82-78 - Noise Abatement Activities - Helms InitiativeRESOLUTION NO. 82 -78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SUPPORTING THE U.S. CONFERENCE OF MAYORS' POSITION RE URGING THE ADMINISTRATION TO REFRAIN FROM IMPLEMENTING INITIATIVES WHICH PROHIBIT LOCAL GOVERNMENTS FROM ESTABLISHING NOISE ABATEMENT ACTIVITIES • (HELMS INITIATIVE) AND DIRECTING THE CITY CLERK TO FORWARD SAME TO USCM REPRESENTATIVE WHEREAS, the Federal Aviation Administrator, J. Lynn Helms, has indicated his intention to restrict local government authority to implement noise abatement procedures where those procedures limit air travel at airports managed by local governments; and WHEREAS, airport noise has a recognized negative effect on the health, safety and welfare of the residents of communities located close to airports; and WHEREAS, local governments have concern and responsibility for the health, safety and welfare of their citizens; and WHEREAS, noise abatement procedures have been in operation at numerous airports for ten years and longer which restrict air travel to reduce the negative effects of airport noise without endangering the safety of air travellers; and WHEREAS, airport operator; are local governments and are entitled to manage their own affairs and relationships with neighboring local governments; and WHEREAS, it is bad public policy for the Federal government to preempt local governments, as proposed in the Helms initiative, on issues which are local in origin and impact; and WHEREAS, laws submitting local government decisions to review by a Federal appointee, as indicated in the Helms initiative, also constitute bad public policy; and WHEREAS, the Administration's "New Federalism" seeks to return authority to local governments, rather than restrict it, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach urges the Administration and J. Lynn Helms to refrain from implementing the announced initiative to prohibit local governments from establishing noise abatement • activities without prior approval of the FAA Administrator.
