RESOLUTION NO. 82 -79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING AN IRREVOCABLE
OFFER TO CONVEY EASEMENT FROM WILLIAM J.
CAGNEY FOR TEN FT. OF STREET RIGHT -OF -WAY AT
3530 IRVINE AVENUE
WHEREAS, in 1966 an Irrevocable Offer to Convey an
Easement, for a 10 ft. wide strip of land across his property,
was executed by William J. Cagney, a copy of which is attached
hereto as Exhibit "A ", pursuant to requirements imposed by the
County of Orange for use if said property was required for street
and highway purposes; and
WHEREAS, in 1971 the City of Newport Beach annexed
certain property which included the above- referred to parcel of
land; and
WHEREAS, Section 989 of the Streets and Highway Code
provides, among other things, for the! transfer of interests in
the street system upon annexation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby accepts the Irrevocable Offer to
Convey Easement from William J. Cagney for the southeasterly 10
ft. of the northwesterly 20 ft. of the northeasterly half of Lot
79, Tract No. 706, as shown on Dwg. R- 5426 -5 attached hereto as
Exhibit "B ";
BE IT FURTHER RESOLVED that. the City Clerk be and
hereby is authorized and directed to execute said document and
attach thereto a Certificate of Acceptance and to cause said
document to be recorded in the Orange. County Recorder's Office.
ADOPTED this 14th day of June , 1982.
