A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA ADOPTING REGULA- TIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS THEREOF FOR THE STATEWIDE GENERAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 2ND DAY OF NOVEMBER, 1982 WHEREAS, Section 10012 of the Elections Code of the State of California authorizes the governing body of any local agency to adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs thereof; and WHEREAS, it is the opinion of the Attorney General of the State of California (No. CV 76/5,, May didate may not be billed for the addition, candidates' statements in Spanish if such the candidate but were required solely by ments to the Federal Voting Rights Act of August 6, 1975); 6, 1976) that a can- al cost of preparing were not requested by reason of recent amend - 1965 (Public Law 94 -73, NOW, THEREFORE, the City Council of the City of Newport Beach does hereby RESOLVE, DECLARE, DETERMINE and ORDER as follows: priate form provided by the City Clerk. Such statement may in- clude the name, age and occupation of: the candidate and a brief description of no more than two hundred (200) words of the SECTION 1. That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal Election to be held in the City of Newport Beach on the 2nd day of • November, 1982, may prepare a candidate's statement on an appro- priate form provided by the City Clerk. Such statement may in- clude the name, age and occupation of: the candidate and a brief description of no more than two hundred (200) words of the candidate's education and qualifications expressed by the candidate himself. Such statement shall not include party • affiliation of the candidate, nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. SECTION 2. That in compliance with the recent amend- ments to the Federal Voting Rights Act of 1965 (Public Law 94 -73, August 6, 1975) the City Clerk shall provide a Spanish transla- tion of the candidate's statement to be made available to anyone requesting the translation. SECTION 3. That the City Clerk shall send to each voter with the sample ballot, a voter's pamphlet which contains the statement of each candidate in English (and Spanish for those candidates who have requested the translation) pursuant to law. SECTION 4. Each candidate filing a statement shall pay to the City in advance his or her pro rata share of the total cost of printing, handling, translating and mailing the candidates' statements per the local agency's estimates. In the event of overpayment, the Clerk shall prorate the excess amount among the candidates and refund the excess amount within 30 days of the election. SECTION 5. That the City Clerk shall provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. • SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City and shall make a minute of passage and adoption therecf in the records of the 2 proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
