TITLE: Recreation Contract Reporting
ABSTRACT:
Per Council Policy F -14, the Finance Director and the City Manager are required to
report to Council if payments to independent instructional and recreational contractors
have exceeded $120,000 during the term of the contract. Two contracts exceeded the
$120,000 threshold and are being reported to Council in this report.
RECOMMENDATION:
Receive and file report. Provide input as desired.
FUNDING REQUIREMENTS:
Payments to recreational contractors were previously appropriated by Council during
budget adoption and therefore no additional funding is required.
DISCUSSION:
Council Policy F -14, Authority to Contract for Services, authorizes department directors
to award and sign contracts with independent contractors for instructional, educational,
cultural, or recreational purposes. The fees paid by the City are based upon either a
percentage of fees collected by the City for a program or on a flat rate basis for tasks
performed by the Contractor. Contracts for such independent contractors may be up to
two years in duration. Per the policy, the City Manager will give written notice to the City
Council should fees paid to any contractor exceed $120,000 during the term of the
contract.

ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
