HomeMy WebLinkAbout82-115 - Special Election - North Star Beach• • RESOLUTION NO. 82 -115 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 2, 1982, FOR SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY A RESOLUTION RELATING TO THE LEASE OF WATERFRONT PROPERTY BY THE CITY OF NEWPORT BEACH FOR THE PURPOSE OF CONSTRUCTING AN AQUATIC CENTER ON NORTH STAR BEACH WHEREAS, the City of Newport Beach, on January 9, 1978, by Resolution No. 9262, accepted a Grant Deed from the County of Orange, conveying to the City of Newport Beach a one -half interest in certain real property described as follows: "A parcel of land in Upper Newport Bay adjacent to Block 53, Irvine's Subdivision in the City of Newport Beach, County of Orange, State of California, as shown on a map recorded in Book 1, page 88 of Miscellaneous Maps in the Office of the County Recorder of said Orange County being bounded as follows: Bounded northerly and northwesterly by the southerly and southeasterly boundary lines of the land described in parcel 3 in a deed to the County of Orange, et al., recorded April 22, 1975, in Book 11382, page 1923 of Official Records in the Office of said County Recorder. Bounded southwesterly by the northeasterly line of North Star Lane as shown on a map of Tract No. 4224, recorded in Book 157, pages 1 through 14 of said Miscellaneous Maps. Bounded easterly and southeasterly by the westerly line of that certain parcel of land described in a deed to the State of California, recorded March 30, 1976, in Book 11688, page 1455 of said Official Records." and commonly known as North Star Beach; and WHEREAS, on March 22, 1982, and again on July 12, 1982, the City Council of the City of Newport Beach approved, in concept, the construction of an aquatic center for human - powered craft and related activities that are supportive of the primary use on North Star Beach; and WHEREAS, the proposed facility, based upon the plan presented to the City Council, would be constructed by Newport Beach Aquatic Center, a non - profit corporation, without cost to the City of Newport Beach; and • • WHEREAS, the financial commitments necessary to ensure construction of the aquatic center without cost to the City will be difficult, if not impossible, to obtain in the absence of a long -term commitment of the City of Newport Beach to lease, to Newport Beach Aquatic Center, its interest in North Star Beach for purposes of constructing the facility; and WHEREAS, the City of Newport Beach will, in consideration of the ground lease, receive the right to use a portion of the aquatic center, at certain times, for recreational purposes; and WHEREAS, the City Charter of the City of Newport Beach provides that no waterfront or beach property owned by the City shall be leased unless and until the leasing of the property has been approved by a majority of the electors voting on such a proposition at a special election; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the provisions of the City Charter of the City of Newport Beach and the laws of the State of California relating to Municipal Elections, there shall be, and there is hereby called and ordered held, in the City of Newport Beach, County of Orange, State of California, on Tuesday, November 2, 1982, a Special Municipal Election of the qualified electors of said City for the purpose! of submitting the following ballot measure, to wit: SHALL THE CITY COUNCIL OF NEWPORT BEACH BE AUTHORIZED TO LEASE, FOR TWENTY -FIVE YES YEARS, ITS INTEREST IN NORTH STAR BEACH TO ALLOW A NON - PROFIT CORPORATION TO CONSTRUCT, AT NO COST TO THE CITY, AN AQUATIC CENTER FOR HUMAN- NO POWERED CRAFT AND RELATED ACTIVITIES THAT ARE SUPPORTIVE OF THE PRIMARY USE SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. 2 SECTION 3. That the polls for said election shall be open at seven o'clock a.m., of the day of said election and shall remain open continuously from said time until eight o'clock (8:00 • p.m.) of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 4. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 5. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby autho- rized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
