A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ESTABLISHING
PENALTIES FOR FAILURE TO PAY THE SEWER
USE CHARGE
• WHEREAS, Section 14.24.065 of the Newport Beach Municipal
provides that a sewer charge shall be established by Resolution of
the City Council; and
WHEREAS, to assist in the collection of unpaid sewer use
charges it has been recommended that penalties be established for
failure to pay; and
WHEREAS, the City Council has considered the penalties
recommended by the City Manager and finds them to be fair, equit-
able, and reasonable; and
WHEREAS, the penalty to be applied does not exceed the
administrative cost of collection required on unpaid sewer use
charges.
NOW, THEREFORE BE IT RESOLVED that the City Council of the
City of Newport Beach hereby establishes a penalty equal to
twenty -five percent of the unpaid balance of the sewer use charge
for accounts over six months in arrears, plus an interest charge
of 1% per month on accounts over six months in arrears.
BE IT FURTHER RESOLVED that the effective date for said
shall be November 1, 1982.
