• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
VACATE AND ABANDON EXCESS RIGHT -OF -WAY ON 28TH
ST. BETWEEN NEWPORT BLVD. AND BALBOA BLVD.
RESULTING FROM STREET REALIGNMENT; ADOPTING A
MAP SHOWING THE AREA TO BE VACATED AND SETTING
A PUBLIC HEARING THEREON (DWG. R/W 5460 -L)
WHEREAS, the
pursuant to provisions
amendments thereto, of
of California, provide
street easements; and
WHEREAS, the
City Council of the City of Newport Beach,
of the Street Vacation Act and all
the Streets and Highways Code of the State
s for vacation and abandonment of public
portion of right -of -way street on 28th St.
between Newport Blvd. and Balboa Blvd. appears to be unnecessary
for present or prospective public use, and it is the intention of
the City Council of the City of Newport Beach to vacate and
abandon said right -of -way; and
WHEREAS, a drawing of the right -of -way to be vacated is
depicted on a map which is attached hereto as Exhibit "A ", and
the legal description of the right -of -way is set forth on Exhibit
"B" attached hereto, which map and legal description are
incorporated herein by reference and made a part of this
Resolution as though fully set forth in full; and
WHEREAS, proceedings for the vacation of the above-
described right -of -way shall be undertaken by the City Council of
the City of Newport Beach pursuant to the provisions of the
Street Vacation Act of 1941 and all amendments thereto, being
Sections 8300 and 8325 and 8340 to 8353 inclusive, of the Streets
• and Highway Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that notice is hereby given that the
City Council of the City of Newport Beach does hereby
fix October 25 , 1982, at the hour of 7:30 p.m. of said day, in
the City Council Chambers of the City of Newport Beach, located
at 3300 Newport Boulevard, Newport Beach, California, as the time
• and place for hearing all persons interested in or objecting to
the proposed vacation of said right -of -way and the City Council
at said time and place will hear the evidence offered by any
person interested in the vacation of the right -of -way
hereinbefore described.
BE IT FURTHER RESOLVED that this Resolution of
Intention shall be published at least once in the official
newspaper of the City, and said publication shall be made before
the date set for the hearing of all persons interested in or
objecting to the proposed vacation.

That portion of 28th Street as shown on a map filed in Book 4, Page 13 of
Miscellaneous Maps, in the office of the County Recorder of Orange County,
California, more particularly described as follows:
Beginning at the most easterly corner of Lot 11, Block 128, of
Lake Tract as shown on said map; thence S.52041' 06" W. 146.74 feet
to the most southerly corner of Lot 16 of said block, said corner being
the point of cusp with the southeasterly line of said Lot 16 with a
curve concave southerly having a radius of 280.00 feet; thence easterly
along said curve through a central angle of 280 58' 17" to the southerly
prolongation of the easterly line of said Lot 11; thence northerly in a
direct line to the point of beginning.
Excepting therefrom that portion lying southeasterly of the centerline
of 28th Street, 50.00 feet wide, as shown on said map.
