• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH - ORDERING THE VACATION AND
ABANDONMENT OF 28TH ST. RIGHT =OF -WAY RESULTING
FROM STREET REALIGNMENT; DIRECTING THE CITY
CLERK TO RECORD SAME WITH THE ORANGE COUNTY
RECORDER'S OFFICE
WHEREAS, the Public Works Director of the City of
Newport Beach, on September 27, 1982, presented to the City
Council of the City of Newport Beach, a certain map prepared by
the Public Works Department dated July 14, 1982 and entitled
"Vacation of Street Right -of- Way," bearing Drawing
No. R/W- 5460 -L, a copy of which is attached hereto as Exhibit "A"
and incorporated herein by reference, that the City of Newport
Beach is considering vacating; and
WHEREAS, the City Council of the City of Newport Beach
approved and adopted said map on September 27, 1982, and directed
the City Clerk to file same in the proceedings for abandonment;
and
WHEREAS, on October 25, 1982, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to said proposed vacation and abandonment; and
WHEREAS, the City Council finds and determines, from
all of the evidence submitted, that the subject right -of -way
described herein and more particularly in Resolution No. 82 -128,
is unnecessary for present or prospective public use and is not
useful as a non - motorized transportation facility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the right -of -way, more
particularly described as follows, be and hereby is ordered
vacated and abandoned:
That portion of 28th Street as shown on a map
filed in Book 4, Page 13 of Miscellaneous
Maps, in the office of the County Recorder of
Orange County, California, more particularly
described as follows:
Beginning at the most easterly corner of Lot
11, Block 128, of �ake Tract as shown on said
map; thence S. 52 41106" W. 146.74 feet to
the most southerly corner of Lot 16 of said
block, said corner being the point of cusp
with the southeasterly line of said Lot 16
with a curve concave southerly having a radius
of 280.00 feet; thence easterly al8ng said
curve through a central angle of 28 57117" to
the southerly prolongation of the easterly
line of said Lot 11; thence northerly in a
direct line to the point of beginning.
Excepting therefrom that portion lying
southeasterly of the centerline of 28th Steet,
50.00 feet wide, as shown on said map.
BE IT FURTHER RESOLVED that the City Clerk is hereby
ordered. to cause a certified copy of such order, attested by the
Clerk under the seal of the City of Newport Beach, to be recorded
in the Office of the County Recorder in and for the County of
Orange.
ADOPTED this 25th day of October, 1982.
