A RESOLUT -ION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH EMPOWERING THE MARINE
DIRECTOR TO CONTRACT FOR EMERGENCY REPAIRS TO
THE BALBOA YACHT BASIN AND AUTHORIZING A
BUDGET AMENDMENT IN THE AMOUNT OF THIRTY
THOUSAND'DOLLARS ($30,000) TO-FUND'THESE
REPAIRS
WHEREAS, the Balboa Yacht Basin is a marine facility
owned by the City of Newport Beach; and
WHEREAS, on November 30, 1982, a severe storm struck
the City of Newport Beach; the storm was accompanied by gusts of
wind exceeding 75 mph; and
WHEREAS, the extremely high winds associated with the
severe storm also occurred at a time when tides were extremely
high; and
WHEREAS, the high winds, which were unanticipated and
unforeseeable, in combination with the extremely high tides,
created highly unusual conditions which resulted in significant
damage to the docks and pilings located within the Balboa Yacht
Basin; and
WHEREAS, the damage to the pilings and docks created by
the extremely rare, natural conditions, has forced the relocation
of 73 vessels, previously situated within the Balboa Yacht Basin
and created other conditions which require the prompt repair of
the Balboa Yacht Basin, to ensure the preservation of property;
and
WHEREAS, the Marine Director has negotiated with both
Trautwein Brothers and Gillis & Derby, the marine contractors
most qualified to perform the repairs and, as a result of these
• negotiation, both firms have agreed to perform repair work, on a
time and materials basis, such that the preliminary estimate of
the cost of repair will, in all probability, not exceed
$30,000.00.

NOW THEREFORE, the City Council of the City of Newport
Beach does hereby resolve as follows :,
1. The damage to the Balboa Yacht Basin caused by
hurricane force winds in combination with extremely high tides
must be repaired promptly to ensure the preservation of
property; by virture of this urgent necessity, the City Council
of the City of Newport Beach is empowered to contract for the
repairs without advertising for bids; and
2. The Marine Director or City Manager is hereby
authorized to contract for repairs to be made to the Balboa Yacht
Basin, the repairs to be made by qualified marine contractors, on
a time and materials basis; and
3. Budget amendments are hereby authorized in the sum
of Thirty Thousand Dollars ($30,000.00) to fund the repairs to
the Balboa Yacht Basin as authorized herein.
