A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DESIGNATING CERTAIN UN-
INHABITED TERRITORY DESIGNATED AS SAN JOAQUIN
RESERVOIR ANNEXATION NO. 89 AS UNDEVELOPED
PROPERTY PURSUANT TO THE MASTER PROPERTY TAX
TRANSFER AGREEMENT BETWEEN THE COUNTY OF
ORANGE AND THE CITY OF NEWPORT BEACH
• WHEREAS, a petition for the proposed annexation desig-
nated SAN JOAQUIN RESERVOIR ANNEXATION NO. 89, to the City of
Newport Beach, in the County of Orange, was heretofore filed by
the owners of said property and accepted for filing by the
Executive Officer of the Local Agency Formation Commission of
Orange County, California, (hereinafter "Commission "), pursuant
to Part 2 of Title 4, Division 2, commencing with Section 35000
et seq., of the Government Code; and
WHEREAS, the distinctive short form designation assign-
ed by the City of Newport Beach to the territory proposed to be
annexed is: SAN JOAQUIN RESERVOIR ANNEXATION NO. 89 TO THE CITY
OF NEWPORT BEACH; and
WHEREAS, said territory proposed to be annexed to the
City of Newport Beach consists of approximately 2.437 acres of
land, and the exterior boundaries thereof are specifically des -
cribed,in the legal description attached hereto, marked Exhibit
"A" and by this reference made a part hereof; and
WHEREAS, that certain Master Property Tax Transfer
Agreement between the County of Orange and the City of Newport
Beach dated October 28, 1980, provides that the County of Orange
and the City of Newport Beach shall agree, in writing, as to
whether said territory to be annexed shall be deemed developed or
undeveloped property for the purpose of transfer of property
taxes, pursuant to Section 99(b) of the Revenue and Taxation Code
of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
• the City of Newport Beach that, pursuant to the provisions of
Paragraph 6 a(1) (d) of that certain Master Property Tax Transfer
Agreement between the County of Orange and the City of Newport
Beach dated October 28, 1980, (hereinafter "Agreement "), that
said territory to be annexed to the City of Newport Beach shall
be deemed and treated as "undeveloped" property, for purposes of
compliance with said Agreement.
