HomeMy WebLinkAbout83-22 - Ad Hoc Election Procedure Review CommitteeRESOLUTION NO. 83 -22 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING AN AD HOC ELECTION PROCEDURE REVIEW COMMITTEE WHEREAS, during the course of, and subsequent to, the recent general election, questions arose concerning the proper application of certain provisions of the Campaign Contribution Ordinance, and City Charter of the City of Newport Beach; and WHEREAS, recent rulings of the State and U.S. Supreme Court relative to campaign financing require a review of the provisions of the Campaign Contribution Ordinance of the City of Newport Beach; and WHEREAS, it is appropriate to establish a committee to review the Campaign Contribution Ordinance and City Charter of the City of Newport Beach, and any Ordinance related thereto, to determine if modification should be made to those Ordinances and Charter provisions to ensure: A. That the purpose and intent of the Campaign Contribution Ordinance is fulfilled; B. That the Ordinances and Charter provisions are internally consistent and consistent with State law; and C. That the procedures adopted by the City of Newport Beach will, to the extent possible, eliminate confusion in the electoral process and ensure fair and impartial results. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Ad Hoc Election Procedure Review Committee is hereby created. • BE IT FURTHER RESOLVED that the composition and duties of the Committee, the members of which are to be appointed by the • Mayor, shall be as follows: 1. Three members (3) of the City Council of the City of Newport-Beach; one (1) resident of the City of Newport Beach and the City Attorney for the City of Newport Beach; 2. The Committee shall have the responsibility of reviewing the ordinances of the City of Newport Beach relative to campaign financing and suggesting modifications or amendments to that ordinance to ensure that the purpose and intent thereof is fulfilled. The Committee shall also review provisions of the Charter of the City of Newport Beach and ordinances related to elections and suggest modifications such that provisions of each are internally consistent and conform with State law. 3. The Committee shall report its findings and recommendations to the City Council on or before June 6, 1983, and the Committee shall cease to exist on September 30, 1983.
