• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING RESOLUTION NO. 82 -10
REGARDING CLARIFICATION OF HOURS OF OPERATION
AND OTHER MATTERS RELATING THE STORAGE AND
TOWING OF VEHICLES
WHEREAS, on July 26, 1982 the City Council of the City
of Newport Beach adopted Resolution No. 82 -110, thereby approving
the tow truck rates and schedules for tow services within the
City'of Newport Beach for G & W Towing, Inc. and Harbor Towing;
and
WHEREAS, Resolution No. 82 -110 established, for both
private and official tows, that vehicles would be released
without a storage fee regardless of the hour of release, when the
release request occurs within a 12 hour period of the storage or
impound of the vehicle; and
WHEREAS, it was the intention of Harbor Towing and G &
W Towing that the provisions of Resolution No. 82 -110 relative to
storage to fees would be applicable only to official police tows;
and
WHEREAS, the terms of Resolution No. 82 -110 have
created confusion with regard to both release fees and the
business hours for purposes of official police tows and private
tows; and
WHEREAS, G & W Towing and Harbor Towing have requested
a modification to Resolution No. 82 -110 to eliminate the
confusion and conform fees and rates authorized by that
Resolution with the requirements of the Newport Beach Municipal
Code; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that Section 1 on Page 3 of Resolution
No. 82 -110 is hereby amended to read as follows:
Pursuant to the provisions of Chapter 5.15 of
the Newport Beach Municipal Code vehicles
impounded or stored by virtue of official
police towing operations will be released
without a storage fee charge regardless of the
hour of release, when the release request,
occurs within a 12 hour period from actual
storage or impound, and no after hours release
fee will bee charged for vehicles released
between 7:00 a.m. and 7:00 p.m. The
provisions of this Section shall apply only to
vehicles stored or impounded pursuant to
official police tows and, in the case of
private tows, G & W Towing, Inc. and Harbor
Towing are authorized to enclose storage
charges commencing at the time that the
vehicle is stored or impounded, and are
further authorized to charge after hour
release fees if the request for release is
received between the hours of 5:00 p.m. and
8:00 a.m.
