A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH DECLARING CITY'S INTENTION TO
VACATE A PORTION OF 32ND ST.; ACCEPTING A MAP
SHOWING THE PORTION PROPOSED TO BE VACATED;
AND SETTING SEPTEMBER 12, 1983, AS THE DATE
FOR A PUBLIC HEARING CONCERNING THE INTENDED
VACATION (DWG. $5473 -L)
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act and all
amendments thereto, being Sections 8300 to 8325 and 8340 to 8353
inclusive, of the Streets and Highways Code of the State of
California, provides for the vacation of easements; and
WHEREAS, on April 21, 1983, the Planning Commission of
the City of Newport Beach conditionally approved Tentative Tract
No. 11906. A condition of approval for this development required
that a portion of the 32nd St. right -of -way be vacated by the
City prior to recordation of the final map; and
WHEREAS, the area to be vacated is legally described on
Exhibit "A" hereto and depicted on a map attached hereto as
Exhibit "B" and incorporated herein by reference; and
WHEREAS, the developer will rededicate the required
right -of -way for the 32nd St. extension with the recordation of
Tract 11906. The proposed vacation will be recorded at the same
time that the final Tract Map 11906 is recorded in order to
ensure that the City retains the right -of -way for the 32nd St.
extension; and
WHEREAS, the subject property is presently unimproved
with no access from adjacent property owners; and
• WHEREAS, proceedings for the vacation of the above -
described alley shall be undertaken by the City Council of the
City of Newport Beach pursuant to the provisions of the Street
Vacation Act of 1941 and all amendments thereto, being Sections
8300 and 8325 and 8340 to 8353 inclusive, of the Streets and
Highway Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that notice is hereby given that the
• City Council of the City of Newport Beach does hereby fix
September 12, 1983 at the hour of 7:30 p.m. of said day, in the
City Council Chambers of the City of Newport Beach, located at
3300 Newport Boulevard, Newport Beach, California, as the time
and place for hearing all persons interested in or objecting to
the proposed vacation of said alley, and the City Council at said
time and place will hear the evidence offered by any person
interested in the vacation of said right -of -way herein described.
BE IT FURTHER RESOLVED that this Resolution of
Intention shall be published at least once in the official news-
paper of the City, and said publication shall be made before the
date set for the hearing of all persons interested in or object-
ing to the proposed vacation.

map and bounded on the northeast by the southeasterly prolongation of the
northeasterly line of Parcel "D" as shown on a Parcel Map recorded .in book
32, page 41, of Parcel Maps in the office of the County Recorder of said County.
