RESOLUTION NO. 83 -94
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING THE VACATION OF AN
EXISTING 20 -FT. ALLEY BETWEEN ST. ANDREWS ROAD
& 15TH ST., SAID VACATION CONDITIONED UPON
CERTAIN FINDINGS AND DIRECTING THE CITY CLERK
TO RECORD SAID RESOLUTION UPON COMPLETION
THEREOF
WHEREAS, the Public Works Director of the City of
Newport Beach has presented to the City Council of the City of
Newport Beach, a certain drawing prepared by the Public Works
Department, No. R/W- 5474 -L, dated August 15, 1983, a copy of
which is attached hereto as Exhibit "A" and which shows the area
the City is considering vacating; and
WHEREAS, on August 22 , 1983, the City Council
adopted Resolution No. 83 -87 declaring the City's inten-
tion to vacate the existing 20 ft. alley located between St.
Andrews Road and 15th St., directing the City Clerk to file same
in the proceedings for vacation, and setting September 12, 1983
as the date for a public hearing thereon; and
WHEREAS, on September 12, 1983, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to the proposed vacation of the above - described
alley; and
WHEREAS, said vacation is to be completed and recorded
after the public sewer presently located within the alley has
been relocated to the satisfaction of the Public Works Department
and the recordation of Resubdivision No. 723; and
WHEREAS, the City Council finds and determines, from

all of the evidence submitted, that
the portion
of the subject
alley described herein, as being a
portion of an
existing
unimproved 20 ft, alley located between St. Andrews Road and 15th
St., which area is more particularly depicted on a map attached
hereto as Exhibit "A ", is unnecessary for present or prospective
public use; and

WHEREAS, the City Council finds.
1. An initial study has been prepared in compliance with
California Environmental Quality Act (CEQA) and the CEQA
Guidelines; and
2. A final environmental impact report has been prepared in
conjunction with the construction of St. Andrews church;
and
3. The final environmental document was certified as ade-
quate by the City Council in conjunction with its ap-
proval of Resubdivision No. 723; and
4. The final environmental impact report fully and
adequately discusses the environmental impacts associat-
ed with the vacation of the alley presently under con-
sideration; and
5. Based upon the .initial study, there have been no sub-
sequent changes in the project analyzed in the final
environmental document that would require revisions; and
6. Based upon information contained in the initial study,
there are no new significant environmental impacts that
were not considered in the prior environmental document;
and
7. The City Council has previously adopted all measures
necessary to mitigate the environmental impacts
associated with the vacation of the alley to a level of
insignificance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the alley referred to herein is
more particularly depicted on City's Map No. R/W- 5474 -L, a copy
which is attached hereto marked Exhibit "A ", be and hereby is
ORDERED VACATED AND ABANDONED.

BE IT FURTHER RESOLVED that the City Clerk of the City
of Newport Beach be and hereby is ordered to cause a certified
• copy of this Resolution, attested by the Clerk under the seal of
the City of Newport Beach, to be recorded in the Office of the
County Recorder for the County of Orange, upon satisfactory com-
pletion of the above conditions and findings by the Public Works
Department of the City of Newport Beach.
