HomeMy WebLinkAbout83-97 - Vacate a Public Utility EasementRESOLUTION N0. 83 -97 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO VACATE A PUBLIC UTILITY EASEMENT WITHIN REIMS LANE - TRACT NO. 8336; ADOPTING A MAP SHOWING THE AREA TO BE VACATED AND SETTING A PUBLIC HEARING THEREON (DWG. R/W 5472 -L) WHEREAS, the City Council of the City of Newport Beach, pursuant to provisions of the Street Vacation Act and all amendments thereto of the Streets and Highways Code of the State of California, provides for vacation and abandonment of public street easements; and WHEREAS, a drawing and legal description of the blanket easement to be vacated is depicted on a map and legal description, both of which are respectively attached hereto as Exhibits "A" and "B ", which map and legal description are incorporated herein by reference and made a part of this Resolution as though fully set forth at length; and WHEREAS, proceedings for the vacation of the above- described easement shall be undertaken by the City Council of the City of Newport Beach pursuant to the provisions of the Street Vacation Act of 1941 and all amendments thereto, being Sections 8300 and 8325 and 8340 to 8353 inclusive, of the Streets and Highway Code of the State of California; • NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that notice is given that the City • Council of the City of Newport Beach does hereby fix October 24, 1983, at the hour of 7:30 p.m. of said day, in the City Council Chambers of the City of Newport Beach, located at 3300 Newport Boulevard, Newport Beach, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation and abandonment of the public utility easement located in the Reims Lane Tract No. 8336; the City Council at said time and place will hear the evidence offered by any person interested in the vacation of the easement hereinbefore described. BE IT FURTHER RESOLVED that this Resolution of Intention shall be published and posted as required by Sections 8322 and 8323 of the Streets and Highways Code. PROOFED VACATION OF AN EASEMENT FOR INGRESS AND EGRESS, PUBLIC UTILITIES, STORM DRAIN AND SANITARY SEWER PURPOSES That certain easement within Reims Lane in the City of Newport Beach as shown on a map of Tract No. 8336 filed in Book 439, Pages 8 through 12, of Miscellaneous Maps in the Office of the County Recorder of the County of Orange, State of California, described as follows: BEGINNING at the centerline intersection of Stare Lane and Reims Lane as shown on said map, said centerline of Reims Lane being the beginning of a curve concave northerly and having a radius of 100.00 feet, a radial line of said curve through said beginning bears South 39006'47" West; thence, southeasterly, easterly and north- easterly 104.70 feet along said curve through a central angle of 59059'25 "; thence, tangent to said curve, North 69007'22" East 47.03 feet; thence, leaving said center- line at right angles South 20052'38" East 16.00 feet to a point in the southerly line of said Reims Lane, said point being the TRUE POINT OF BEGINNING; thence, paral- lel with said centerline, South 69007'22" West 47.03 feet to the beginning of a curve concentric to the centerline of said Reims Lane, concave northerly and having a radius of 116.00 feet; thence, southwesterly, westerly and northwesterly 91.09 feet along said curve through a central angle of 44059'29" to the beginning of a reverse curve concave southeasterly and having a radius of 23.00 feet; a radial line of said curve through said beginning bears North 24006'51" East; thence, northwesterly, westerly and southwesterly 30.33 feet along said curve through a central angle of 75033'12" to a point on a curve concentric to the centerline of said Stare Lane, concave southeasterly and having a radius of 164.00 feet; a radial line of said curve 3 40 Vacation of Public Utility Easement, Reims Lane - -Tract No. 8336 Page 2 through said point bears North 51026'21" West; thence, northeasterly 46.32 feet along said curve through a central angle of 16010'54" to the beginning of a reverse curve concave northwesterly having a radius of 216.00 feet and being concentric to said centerline of Stare Lane; a radial line of said curve through said beginning •bears South 35015'27" East; thence, northeasterly 31.15 feet along said curve through a central angle of 08015'42" to the beginning of a curve concave northeasterly and having a radius of 13.00 feet; a radial line of said curve through said beginning bears North 43031109" West; thence, southwesterly, southerly, southeasterly, east- erly and northeasterly 39.02 feet along said curve through a central angle of 171058'43" to the beginning of a compound curve concave northwesterly and having a radius of 70.00 feet; a radial line of said curve through said beginning bears South 35029'52" East; thence, northeasterly 50.23 feet along said curve through a central angle of 41006'56" to the beginning of a reverse curve concave southwesterly and having a radius of 44.00 feet; a radial line of said curve through said begin- ning bears North 76036'48" West; thence, northeasterly, easterly, southerly and southwesterly 181.03 feet along said curve through a central angle of 235044'10" to the TRUE POINT OF BEGINNING. Reserving therefrom an easement for the maintenance and repair of Southern California Edison underground electrical facilities, said easement being a strip of land, 4.00 feet wide, the southeasterly line of which is described as follows: A line parallel with and 20.00 feet southeasterly, measured radially, from the centerline of said Stare Lane. The side lines of the above described 4.00 -foot strip of land shall be prolonged or shortened so as to terminate at their points of intersection with the right -of -way boundary of said Reims Lane.
