TITLE: APPOINTMENT OF DISTRICT 1 ALTERNATE MEMBER TO THE
AVIATION COMMITTEE
ABSTRACT:
The District 1 Alternate Member seat on the Aviation Committee is currently vacant and
Council Member Mike Henn nominated Donald Hecht, subject to City Council
confirmation, to fill the vacancy.
RECOMMENDATION:
a) Waive the portion of City Council Policy A -2, (Board, Commission, and
Committee Appointments) which requires an appointee to be a qualified elector
of the City.
b) Confirm Council Member Mike Henn's nomination of Donald Hecht as the
District 1 Alternate Member to the Aviation Committee.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Resolution No. 2011 -31, which established the membership of the Aviation Committee
states, in part, that the Aviation Committee shall consist of seven members, one from
each City Council District, nominated by the District Council Member and confirmed by
the City Council; and seven alternates, one from each City Council District, nominated
by the District Council Member and confirmed by the City Council.

The District 1 alternate member position on the Aviation Committee is vacant. Council
Member Mike Henn has nominated Donald Hecht to fill that position. Mr. Hecht owns a
home in District 1, but is not registered to vote within the City. Resolution No. 2011 -31
provides. "[c]ertain committee members do not have to be residents of the ... [City] ... if
they bring specific expertise to the Committee that may be unavailable within the City."
Mr. Hecht is familiar with the impact of John Wayne Airport on our community, and he
brings expertise to the Aviation Committee that will enhance discussion and
collaboration. If confirmed by the City Council, Donald Hecht will serve a four year term
on the Aviation Committee.
Pursuant to City Council Policy A -2, Board, Commission and Committee Appointments,
the City Clerk prepared a Vacancy Notice for posting and publication of the
unscheduled vacancy. The District 1 Alternate Member position has been posted in the
City Clerk's Office and on the City's bulletin board since February 14, 2012. The
vacancy was also included as part of the Maddy Act publication on December 22, 2012.
The City Clerk's Office also included this vacant seat in Vacancy Notice publications
published on January 12, 2013 and January 26, 2013, with no applications being filled
until now. Further, pursuant to City Council Policy A -2, Mr. Hecht has an application on
file in the City Clerk's Office (Attachment A) and is not currently sitting on any other City
Board, Commission or Committee. However, as mentioned, Mr. Hecht is not a qualified
elector of the City, thus, staff is recommending the City Council waive that portion of
City Council Policy A -2.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find the appointment of Mr. Hecht to the Aviation
Committee is not subject to the California Environmental Quality Act ( "CEQA ") pursuant
to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a
project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical
change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
