TITLE: Resolution Establishing Underground Utility District No. 22 – Balboa
Boulevard between West Coast Highway and 22nd Street
ABSTRACT:
The City Council established the undergrounding of overhead utilities on Balboa
Boulevard between West Coast Highway and 22"d Street as a high priority project and
directed staff to proceed with a Rule 20A undergrounding project. The first step in this
process is formation of an Underground Utility District according to Chapter 15.32 of the
Newport Beach Municipal Code. It is recommended that the City Council hold a Public
Hearing to establish Underground Utility District No. 22 and order the removal of poles,
overhead wires, and associated overhead structures within the district boundary.
RECOMMENDATIONS:
1. Conduct a Public Hearing on formation of Underground Utility District No. 22.
2. If so desired, adopt Resolution No. 2013- 75 , "A Resolution of the City
Council of the City of Newport Beach Establishing Underground Utilities District
No. 22 (Balboa Boulevard between West Coast Highway and 22nd Street) and
Ordering the Removal of Poles, Overhead wires, and Associated Overhead
Structures within Underground Utility District No. 22."
Direct staff to initiate project implementation.
FUNDING REQUIREMENTS:
Project costs will be funded by the City's Rule 20A allocation.

DISCUSSION:
CPUC sets Rule 20 policies and procedures for the conversion of overhead utilities to
underground. Rule 20 undergrounding projects may be either financed by utility rate
funds, combined rate funds and local tax proceeds or private funds; depending on
whether the project is classified under Rule 20A, 20B, or 20C provisions.
Rule 20A projects are paid for by the utility's ratepayers. To qualify for funding through
these proceeds, projects must produce a benefit to the general public, not just
customers in the affected area, by satisfying one or more of the following criteria:
• The location has an unusually heavy concentration of overhead facilities;
• The location is heavily travelled;
• The location is an arterial or major collector road in a city's general plan; and/or
• The overhead equipment must be located within or pass through a civic,
recreational, or scenic area.
The City currently has $1,705,300 of Rule 20A funds. SCE allows an agency to
mortgage up to five years of Rule 20A allocation. Based on the City's current allocation,
the estimated amount of mortgaging is $1,374,805. Combining the current balance,
three additional years of 20a funding as well as mortgaging, the City should have
approximately $3,904,985 in Rule 20A funds available for undergrounding to start the
project in 2016.
Per City Council's recommendation at the March 26, 2013 Regular Session, and the
September 10, 2013 Study Session, it was determined that Underground Utility District
No. 22 (UUD No. 22) — Balboa Boulevard between West Coast Highway and 22nd Street
qualifies as a Rule 20A project and is the City's highest priority undergrounding project.
The undergrounding of overhead utilities in this district complements the revitalization
vision set forth by the West Newport Citizen Advisory Panel.
The existing overhead utilities along Balboa Boulevard provide services to a number of
residences to the north and south. It is understood that the undergrounding will extend
into the residential neighborhood to provide a reasonable overhead -to -underground
terminus. In accordance with the City's Municipal Code, property owners within the
UUD boundary will be required to convert private overhead services to connect to the
underground system at their own expense. The exact locations of overhead termination
and impacted properties will be determined in the design phase based on SCE Rule
20A guidelines and field conditions.
As proposed, UUD No. 22 will be funded with Rule 20A credits. The estimated project
cost is approximately $3.8 million, not including the cost for conversion of private

service connections. The estimated cost of conversion for each property owner is
expected to be approximately $3,000 - $5,000 depending on the type and location of
existing service connections.
The anticipated project schedule is to begin construction in approximately Spring 2016
(following initiation of the design phase) and complete the project is Fall 2017. A refined
cost estimate and project schedule will be available at completion of the design phase.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ("CEQA") pursuant to Section 15302(d) (conversion of
overhead electric utility distribution system facilities to underground including connection
to existing overhead electric utility distribution lines where the surface is restored to the
condition existing prior to the undergrounding) of the CEQA Guidelines, California Code
of Regulations, Title 14, Chapter 3, because it has no potential to have a significant
effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
Notification of this Public Hearing was distributed (mailed and posted) to affected
property owners pursuant to City's Municipal Code Section 15.32.020.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING UNDERGROUND UTILITIES
DISTRICT NO. 22 (BALBOA BOULEVARD BETWEEN WEST
COAST HIGHWAY AND 22nd STREET) AND ORDERING THE
REMOVAL OF POLES, OVERHEAD WIRES, AND ASSOCIATED
OVERHEAD STRUCTURES WITHIN UNDERGROUND UTILITY
DISTRICT NO. 22
WHEREAS, Chapter 15.32, entitled "Underground Utilities", of the Newport Beach
Municipal Code ("NBMC"), authorizes the City Council to call public hearings to ascertain
whether the public health, safety or welfare requires the removal of poles, overhead wires
and associated overhead structures within designated areas of the City, and underground
installation of wires and facilities for supplying electric, communication, and similar
services; and
WHEREAS, pursuant to NBMC Section 15.32.020, the City Council took action to
set a public hearing for the 12`h of November, 2013, at 7:00 p.m. for the purpose of
determining whether an underground utilities district should be established within the
certain territory referred to as Underground Utilities District No. 22 (Balboa Boulevard
between West Coast Highway and 22" Street), which is hereinafter described; and
WHEREAS, the City Clerk provided notices to all owners of property and affected
utilities within the proposed underground utilities district at least fifteen (15) days prior to
the date of the public hearing, as prescribed by said NBMC Section 15.32.020; and
WHEREAS, at the public hearing the City Council reviewed the report submitted by
the Public Works Director pursuant to NBMC Section 15.32.030 and heard the testimony
of all interested persons.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The public necessity, health, safety and welfare require the removal of
poles, overhead wires and associated overhead structures used to supply electric,
communication, and similar services, and their installation underground within the following
described areas of the City of Newport Beach:
Those parcels of land located in the City of Newport Beach, County of
Orange, State of California, as described in Exhibit "A" and depicted in
Exhibit "B" ("District').
For reference, the boundary line for the land described above is shown on
City of Newport Beach Drawing No. SD -5084-S, on file in the office of the
Public Works Department.

The City Council further resolves:
Section 2: The District, which includes Balboa Boulevard, along which the work is
to be performed, is extensively used by the general public and carries a heavy volume of
pedestrian and vehicular traffic; and
Section 3: The District is hereby declared to be an underground utilities district,
to be known as Underground Utilities District No. 22, and the affected utility companies
and property owners are ordered to cause the required removal and underground
installation work to be done.
Section 4: The date by which the required removal and underground installation
work is to be accomplished and by which the affected property owners must be ready to
receive underground utility service is June 2016.
Section 5: The City Clerk is directed to notify all affected utility companies and all
persons owning real property within said District of the adoption of this resolution within ten
(10) days after its effective date. The City Clerk shall further notify such affected property
owners of the necessity that if they or any person occupying such property desire to
continue to receive electric, communication, or similar or associated service, they or such
occupant shall provide all necessary facility changes on their premises so as to receive
such service from the lines of the supplying utility or utilities at a new location, subject to
the applicable rules, regulations, and tariffs of the respective utility or utilities on file with
the Commission, in accordance with NBMC Section 15.32.080.
Section 6: This Project is categorically exempt under California Environmental
Quality Act ("CEQA") Regulation Section 15302(d), because it involves the conversion of
overhead electric utility distribution system facilities to underground including connection to
existing overhead electric utility distribution lines where the surface is restored to the
condition existing prior to the undergrounding.
Section 7: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting this resolution.

NOTICE OF PUBLIC HEARING
PURSUANT TO NBMC SECTION 15.32.020
NOTICE IS HEREBY GIVEN that on Tuesday, November 12, 2013 at 7:00p.m., or soon thereafter as the
matter shall be heard, a public hearing will be conducted in the City Council Chambers at 100 Civic Center
Drive, Newport Beach. The City Council of the City of Newport Beach will consider the project, described below,
to determine whether the public necessity, health, safety, or welfare requires the removal of poles, overhead
wires, and associated overhead structures, and the underground installation of wires and facilities for supplying
electric, communication, or similar or associated service in that area of the City.
PROJECT NAME - Underground Utilities District No. 22 (Balboa Boulevard between West Coast Highway and
23rd Street)
For further information regarding the project's location, reference is hereby made to the map showing the
boundaries of the proposed Underground Utilities District No. 22, designated as Drawing No. SD -5084-S, dated
September 30, 2013, which is on file at the Public Works Department located in Bay D on the 2nd Floor at
100 Civic Center Drive, Newport Beach.
This project is categorically exempt under Section 15302(d), of the California Environmental Quality Act
(CEQA) Guidelines — conversion of overhead electric utility distribution system facilities to underground
including connection to existing overhead electric utility distribution lines where the surface is restored to the
condition existing prior to the undergrounding.
All interested parties may appear and present testimony in regard to this project. If you challenge this project in
court, you may be limited to raising only those issues you raised at the public hearing or in written
correspondence delivered to the City, at, or prior to, the public hearing.
The agenda, staff report, and documents may be reviewed at the City Clerk's Office (Bay E, 2nd Floor),
100 Civic Center Drive, Newport Beach, California, 92660, or at the City of Newport Beach's website at

Dear Property Owner:
On November 12, 2013, the City of Newport Beach ("City") City Council adopted Resolution
No. 2013-82 — "A Resolution of the City Council of the City of Newport Beach Establishing
Underground Utilities District No. 22 (Balboa Boulevard between West Coast Highway and
22nd Street) and Ordering the Removal of Poles, Overhead Wires, and Associated Overhead
Structures within Underground Utility District No. 22." The purpose of establishing this
district is to underground the overhead utility poles, lines, and appurtenances along Balboa
Boulevard. As a result, this will impact your overhead utility services.
Pursuant to Newport Beach Municipal Code Section 15.32.080, if you would like to continue
receiving electric, communication, or similar or associated service, you will be required to
convert your existing overhead utility services to underground upon notification from the
City within the prescribed duration noted on subsequent City correspondence and the
abovementioned resolution.
The following is a tentative project schedule:
Design Spring 2015
Construction Spring 2016
Private Utility Conversion* Spring 2017
Pole Removal/Completion Fall 2017
*Private utility conversion will be paid by the property owner.
Additional City correspondence will be provided at a later date providing progress updates,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING UNDERGROUND UTILITIES
DISTRICT NO. 22 (BALBOA BOULEVARD BETWEEN WEST
COAST HIGHWAY AND 22"d STREET) AND ORDERING THE
REMOVAL OF POLES, OVERHEAD WIRES, AND ASSOCIATED
OVERHEAD STRUCTURES WITHIN UNDERGROUND UTILITY
DISTRICT NO. 22
WHEREAS, Chapter 15.32, entitled "Underground Utilities", of the Newport Beach
Municipal Code ("NBMC"), authorizes the City Council to call public hearings to ascertain
whether the public health, safety or welfare requires the removal of poles, overhead wires
and associated overhead structures within designated areas of the City, and underground
installation of wires and facilities for supplying electric, communication, and similar
services; and
WHEREAS, pursuant to NBMC Section 15.32.020, the City Council took action to
set a public hearing for the 12th of November, 2013, at 7:00 p.m. for the purpose of
determining whether an underground utilities district should be established within the
certain territory referred to as Underground Utilities District No. 22 (Balboa Boulevard
between West Coast Highway and 22" Street), which is hereinafter described; and
WHEREAS, the City Clerk provided notices to all owners of property and affected
utilities within the proposed underground utilities district at least fifteen (15) days prior to
the date of the public hearing, as prescribed by said NBMC Section 15.32.020; and
WHEREAS, at the public hearing the City Council reviewed the report submitted by
the Public Works Director pursuant to NBMC Section 15.32.030 and heard the testimony
of all interested persons.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The public necessity, health, safety and welfare require the removal of
poles, overhead wires and associated overhead structures used to supply electric,
communication, and similar services, and their installation underground within the following
described areas of the City of Newport Beach:
Those parcels of land located in the City of Newport Beach, County of
Orange, State of California, as described in Exhibit "A" and depicted in
Exhibit "B" ("District").
For reference, the boundary line for the land described above is shown on
City of Newport Beach Drawing No. SD -5084-S, on file in the office of the
Public Works Department.
The City Council further resolves:
Section 2: The District, which includes Balboa Boulevard, along which the work is
to be performed, is extensively used by the general public and carries a heavy volume of
pedestrian and vehicular traffic; and
Section 3: The District is hereby declared to be an underground utilities district,
to be known as Underground Utilities District No. 22, and the affected utility companies
and property owners are ordered to cause the required removal and underground
installation work to be done.
Section 4: The date by which the required removal and underground installation
work is to be accomplished and by which the affected property owners must be ready to
receive underground utility service is June 2016.
Section 5: The City Clerk is directed to notify all affected utility companies.and all
persons owning real property within said District of the adoption of this resolution within ten
(10) days after its effective date. The City Clerk shall further notify such affected property
owners of the necessity that if they or any person occupying such property desire to
continue to receive electric, communication, or similar or associated service, they or such
occupant shall provide all necessary facility changes on their premises so as to receive
such service from the lines of the supplying utility or utilities at a new location, subject to
the applicable rules, regulations, and tariffs of the respective utility or utilities on file with
the Commission, in accordance with NBMC Section 15.32.080.
Section 6: This Project is categorically exempt under California Environmental
Quality Act ("CEQA") Regulation Section 15302(d), because it involves the conversion of
overhead electric utility distribution system facilities to underground including connection to
existing overhead electric utility distribution lines where the surface is restored to the
condition existing prior to the undergrounding.
Section 7: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting this resolution.
