A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SUMMARILY
VACATING AND ABANDONING A SEWER EASEMENT IN LOT 169, BLOCK 2, OF IRVINE
SUBDIVISION (361 HOSPITAL ROAD) RECORDED ON JUNE 27, 1962, IN BOOK 6159, PAGES
460 THROUGH 463 OF OFFICIAL RECORDS OF ORANGE COUNTY
WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions of
the Street Vacation Act (Section 8330 et sea. of the Streets & Highways Code) is authorized to
summarily vacate and abandon public easements: and
WHEREAS, there is a certain sewer easement across the property at 361 Hospital Road,
Lot 169, Block 2, of Irvine Subdivision, recorded on June 27, 1962, in Book 6159, Pages 460 through
463 of Official Records of Orange County and which is legally depicted on Exhibit "A" attached hereto
and incorporated herein by reference, and described in Exhibit "B" and incorporated herein by
reference as though fully set forth at length herein; and
WHEREAS, the easement above - described has not been used for five years by the City
of Newport Beach or public utilities for the purpose for which it was dedicated or acquired and has
remained continuously unused by the City of Newport Beach or public utility for any public purpose for
a period of five consecutive years; and
WHEREAS, there are no public utility facilities in place that would be affected by the
vacation and abandonment of this easement; and
WHEREAS, the City Council of the City of Newport Beach has reviewed and considered
the various elements of the General Plan of the City of Newport Beach prior to declaring a summary
vacation of easement and has determined that the proposed vacation is consistent with the General
Plan.
WHEREAS, the easement is un- necessary for present or prospective public use, and it is
the desire of the City Council of the City of Newport Beach to vacate the easement, recorded on June
27, 1962, in Book 6159, Pages 460 through 463 of Official Records of Orange County legally
described in Exhibit "A" and depicted on Exhibit "B ", the vacation and abandonment to be processed
pursuant to the provisions of the Street Vacation Act.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach
that the sewer easement recorded on June 27, 1962, in Book 6159, Pages 460 through 463 of Official
Records of Orange County is hereby vacated and abandoned; and
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this
Resolution of Vacation, attested by the Clerk, under seal, to be recorded in the Office of the Recorder
of the County of Orange.

EXHIBIT B
An Easement for Sewer purposes in Lot 169, Block 2, Irvine Subdivision as shown on a
Map recorded in Book 1, Page 88 of Miscellaneous Maps, records of Orange County
California, said easement being a strip of land 10.00 feet wide, 5.00 feet on each side of
a center line described as follows:
• Beginning at the intersection of Placentia Avenue and Superior Avenue (formerly
Newport Avenue) as shown on a record of Survey filed in Book 15, Page 30, of Record
of Surveys in the office of the County Recorder of Orange County, California; thence
South 220 18' 09" East along the center line of Placentia Avenue Extension as deeded
to the County of Orange, recorded April 24, 1951 in Book 2180, Page 236 of Official
Records, a distance of 687.93 feet; thence leaving said center line of Placenta Avenue
South 670 41' 51" East 30.00 feet, to the sideline of said Placentia Avenue, being also
the beginning of a curve tangent to said sideline, concave Southeasterly and having a
radius of 25.00 feet; thence Northeasterly along said curve through a central angle of
900 00'00" an arc distance of 39.27 feet to the beginning of a reverse curve, tangent,
concave Northerly, and having a radius of 426.62 feet; thence Easterly along said curve,
through a central angle of 270 41' 51" , an arc distance of 206.23 feet to a line tangent;
thence along said tangent line North 400 00' 00" East 237.81 feet to the true point of
beginning; thence South 500 00'00" East, 256.76 feet; thence South 220 06' 36" West;
226.35 feet; thence South 00 14' 25" West 83.00 feet to a point in the Northerly line of
that land described in a Record of Survey Map, recorded in Book 15, Page 30, record of
Orange County, California. Said point being 425.48 feet along said Northerly line from
the center line of Placentia Avenue which is shown on a map marked Exhibit "A" which
is attached hereto and by reference, incorporated herein and made a part hereof.
