HomeMy WebLinkAbout96-10 - Planning Commission Amendment 833RESOLUTION NO. 96 -10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING AMENDMENT NO. 833, AMENDING THE NEWPORT PLACE PLANNED COMMUNITY DISTRICT REGULATIONS TO LIMIT AUTOMOBILE STORAGE, REPAIR, AND DETAILING USES WITHIN THE NEWPORT PLACE PLANNED COMMUNITY DISTRICT • (Planning Commission Amendment No. 833) WHEREAS, as part of the development and implementation of the Newport Beach General Plan, the Land Use Element has been prepared; and WHEREAS, the Newport Beach Municipal Code provides specific procedures for the implementation of Planned Community zoning for properties within the City of Newport Beach; and WHEREAS, Section 20.51.045 of the Newport Beach Municipal Code provides that amendments to a Planned Community Development Plan must be approved by a Resolution of the City Council setting forth full particulars of the amendment; and WHEREAS, the Land Use Element of the General Plan states that the purpose of the commercial land use designations are primarily intended to provide retail, office, marine commercial, and visitor- serving uses; and WHEREAS, certain automotive - related uses operating independent of uses which are retail, office, marine commercial or visitor - serving in character are inconsistent with stated purpose of these commercial land use designations; and WHEREAS, the Newport Place Planned Community District Regulations require amendment to limit such uses to those which are ancillary to automobile sales uses or to the principal uses permitted within these districts; and WHEREAS, Chapter 20.51 of the Municipal Code set forth the amendment process as the method of changing the land use regulations of planned community district texts; and WHEREAS, at its meeting of October 5, 1995, the Planning Commission held a public hearing regarding Amendment 833, and indicated that it desired to amend the Newport Place Planned Community District Regulations; and • WHEREAS, the Planning Commission has determined that the proposed amendment is Categorically Exempt (Class 5) from the provisions of the California Environmental Quality Act. r • NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Newport Beach does hereby approve Amendment No. 833 to amend Part II, Section II, Group A (Commercial Uses) of the Newport Place Planned Community District Regulations to read as follows: Part H, Section H, Group A (Commercial Uses) of the Newport Place Planned Community text A. Automobile Center, subject to a use permit. 1. Automobile dealership selling only new cars. The sale of used cars, automobile repair, and automobile detailing may be permitted in conjunction with the sales of new vehicles but only accessory uses. 2. Service stations subject to the issuance of the use permit and a finding that the use is supportive of the principal uses permitted in the Newport Place Planned Community text.
