HomeMy WebLinkAbout96-20 - County Highway Right-of-Way Aquisition• RESOLUTION NO.96 --20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CONCURRING THAT THE PORTIONS OF MESA DRIVE FROM THE INTERSECTION WITH IRVINE AVENUE TO THE INTERSECTION WITH BIRCH STREET WITHIN THE CITY OF NEWPORT BEACH ARE TO BE COUNTY HIGHWAY FOR PURPOSES OF RIGHT OF WAY ACQUISITION AND IMPROVEMENT WHEREAS, the County of Orange plans to realign and widen Mesa Drive and Birch Street between Irvine Avenue and South Bristol Street, as a part of improving the circulation plan within the Santa Ana Heights area; and WHEREAS, the County of Orange proposes to acquire right of way and construct roadway improvements on Mesa Drive which lies mostly within the City of Newport Beach, to be done as part of the larger Mesa Drive /Birch Street improvement project pursuant to the County's Santa Ana Heights Circulation Plan; and WHEREAS, on January 9, 1996, pursuant to Section 1700, Article 3, Chapter 9, Division 2, of the Streets and Highways Code, the County of Orange Board of Supervisors adopted Resolution No. 96-40 declaring the areas within the city limits of the City of Newport Beach required for construction along Mesa Drive to be County Highway for the purposes of right of way acquisition and construction of improvements during the period of project implementation by the County of Orange. Pursuant to Section 1701 of said code, Resolution No. 96 -40 has been transmitted to the City of Newport Beach along with a request for adoption of a resolution of concurrence by the City Council of the City of Newport Beach; and WHEREAS, pursuant to Section 65402 of the Government Code, County has requested City to find project consistency with the City's General Plan for the portion of the project within the City of Newport Beach. NOW, THEREFORE, the City Council of the City of Newport Beach concurs with the County Resolution declaring the areas within the city limits of the City of Newport Beach required for construction along Mesa Drive to be County Highway and consents to include the portion of Mesa Drive from the intersection of Irvine Avenue to the intersection with Birch Street as a County Highway for the purposes of right of way acquisition and construction of improvements during the period of project implementation by the County of Orange.
