HomeMy WebLinkAbout96-53 - Consolidate the 11-5-96 Special MunicipalRESOLUTION NO. 96-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO CONSOLIDATE, PURSUANT TO THE PROVISIONS OF SECTION 10403 OF THE ELECTIONS CODE, A SPECIAL ELECTION TO BE HELD ON NOVEMBER 5, 1996 WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THE SAME • DATE. WHEREAS, the City Council desires to submit to the voters at a special municipal election of November 5, 1996, a proposed amendment to Newport Beach Municipal Code Section 6.04.170 (Initiative Ordinance 878) relating to residential curbside refuse service; and WHEREAS, it is desirable that the Special Election be consolidated with the Statewide General Election to be held on the same date and that within the City the precincts and polling places of the two elections be the same, that the County Registrar of Voters canvass the returns of the General Municipal Election and that the election be held in all respects as if there were only one election. NOW, THEREFORE BE IT RESOLVED, DECLARED, DETERMINED AND ORDERED by the City Council of the City of Newport Beach as follows: Section 1. Pursuant to the provisions of Section 10403 of the Elections Code, the Board of Supervisors of the County of Orange is hereby requested to consent to the consolidation of a Special Municipal Election with the statewide General Election on Tuesday, November 5, 1996, for the purpose of submitting an amendment to Newport Beach Municipal Code Section 6.04.170 (Initiative Ordinance 878) regarding costs for residential curbside refuse service. Section 2. The measure to be submitted to the voters of the City will appear on the ballot as follows: MEASURE • SHALL INITIATIVE ORDINANCE 878 BE AMENDED TO REQUIRE THE CITY OF NEWPORT BEACH TO USE PROPERTY TAX REVENUE TO PAY ONLY FOR THE COST OF PROVIDING CURBSIDE CONTAINER REFUSE COLLECTION FOR EXISTING OR FUTURE RESIDENTIAL UNITS WITHIN CITY BOUNDARIES AS OF NOVEMBER 1, 1996? YES /NO 1 • • The precise wording of the measure to be submitted to the voters pursuant to this Section is attached as Exhibit A. Section 3. That the county election department is authorized to canvass the returns of the Special Municipal Election. The election shall be held in all respects as if there were only one election and only one form of ballot shall be used. Section 4. That the Board of Supervisors is requested to issue instructions to the county election department to take any and all steps necessary for the holding of the consolidated election. Section 5. That the City of Newport Beach recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any such costs. Section 6. That the City Clerk is directed to file a certified copy of this Resolution with the Board of Supervisors and the county election department of the County of Orange. Section 7. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. ADOPTED this 22nd day of July, 1996. ATTEST: l\ , CITY CLERK MAYOR � J t 2 EXHIBIT A RESIDENTIAL REFUSE COLLECTION COSTS DEFRAYED FROM AD VALOREM TAX REVENUE (Ordinance 878 as adopted by a majority vote of the electorate of the City of Newport Beach on 6/2/59, effective 6/19/59) Section 6.04.170. The cost and expense of collecting, hauling away and disposing of garbage, refuse and cuttings as those terms are defined by Sections 6.04.010, 6.04.020 and 6.04.030, for anv dwelling or dwelling unit, existing or future, within the boundaries of the City as of November 1, 1996, that receives curbside container refuse collection service from the City of Newport Beach, shall be defrayed exclusively from the ad valorem tax revenues of the City of Newport Beach.
