HomeMy WebLinkAbout96-54 - City Measure Written Arguements• 0 RESOLUTION NO. 96-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING A CITY MEASURE. WHEREAS, a Special Municipal Election is to be held in the City of Newport Beach, California, on November 5, 1996, at which there will be submitted to the voters the following measure: SHALL INITIATIVE ORDINANCE 878 BE AMENDED TO REQUIRE THE CITY OF NEWPORT BEACH TO USE PROPERTY TAX REVENUE TO PAY ONLY FOR THE COST OF PROVIDING CURBSIDE CONTAINER REFUSE COLLECTION FOR EXISTING OR FUTURE RESIDENTIAL UNITS WITHIN CITY BOUNDARIES AS OF NOVEMBER 1,1996? YES / NO The precise wording of the measure to be submitted to the voters pursuant to this Section is attached as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the City Council authorizes the Chairman of the Legislative Committee to file written arguments regarding the City measure as specified above in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. Section 2. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. ATTEST: CITY CLERK /chi MAYOR 1 EXHIBIT A • RESIDENTIAL REFUSE COLLECTION COSTS DEFRAYED FROM AD VALOREM TAX REVENUE (Ordinance 878 as adopted by a majority vote of the electorate of the City of Newport Beach on 6/2/59, effective 6/19/59) Section 6.04.170. The cost and expense of collecting, hauling away and disposing of garbage, refuse and cuttings as those terms are defined by Sections 6.04.010, 6.04.020 and 6.04.030, for any dwelling or dwelling unit, existing or future, within the boundaries of the City as of November 1, 1996, that receives curbside container refuse collection service from the City of Newport Beach, shall be defrayed exclusively from the ad valorem tax revenues of the City of Newport Beach.
