K/W TITLE: Marina Park �Project —Marina Basin Construction Including Dredging, Bulkheads, Grading and Soil Remediation (Bid Package 2) — Award of Contract No. 3897 -B (CAP09 -0070) ABSTRACT: Staff has received bids for the second of four bid packages for the Marina Park Project — "Marina Basin Construction Including Dredging, Bulkheads, Grading and Soil Remediation" (Bid Package 2), and is requesting City Council approval to award the contract to Dutra Construction Company, Inc. RECOMMENDATIONS: 1. Approve the project drawings and specifications; 2. Award Contract No. 3897 -B (Marina Park Project — "Marina Basin Construction Including Dredging, Bulkheads, Grading and Soil Remediation") to Dutra Construction Company, Inc. ( Dutra) of San Rafael, California, for the total bid price of $4,576,079.00 and authorize the Mayor and City Clerk to execute the contract; and 3. Establish a contingency of $457,607.00 (ten percent) to cover the cost of unforeseen work. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funds for this contract. Dutra Construction Company, Inc. Purpose Construction Contract $ Construction Contingency $ Total: $ Amount 4,576,079.00 457,607.00 5,033,686.00 Staff recommends establishing a ten (10) percent contingency for unforeseen events associated with the construction of a new marina basin. DISCUSSION: The Marina Park Project is divided into four general construction plan sets and bid packages: (1) Site Demolition and Tree Relocation; (2) Marina Basin Construction; (3) Community Center and Park; and (4) Docks. Contract No. 3897 -A - Site Demolition and Tree Relocation was awarded by City Council on October 22, 2013 and is currently underway. This contract, Contract No. 3897 -B, is to award the work related to Bid Package 2, which generally includes improving /stabilizing the underlying ground for the future Community and Sailing Center buildings through the use of stone columns; installing the marina bulkheads /groin walls with dead -man tie backs and pre- fabricated handrail; dredging of the marina basin; and placing and grading of the dredged sand material on to target beaches. The low bidder, Dutra Construction Company, Inc., possesses a California State Contractors License Classification "A" as required by the project specifications. A check of Dutra's and its subcontractors' references indicates satisfactory completion of projects of comparable size and scope. Dutra was the US Army Corps of Engineers' contractor for the recent lower Newport Harbor Dredging project. At 1:30 PM on November 19, 2013, the City Clerk opened and read the following bids for the "Marina Park Project — Marina Basin Construction Including Dredging, Bulkheads, Grading and Soil Remediation" Project: BIDDER TOTAL BID AMOUNT Low Dutra Construction Company, Inc. $4,576,079.00 2 Reyes Construction, Inc. $5,922,580.00 3 Connolly- Pacific Company $6,185,231.25 4 John S. Meek Company, Inc. $6,299,595.00' "John S. Meek Company, Inc. submitted an incomplete bid proposal, rendering its bid non- responsive. The low bid amount is approximately 14 percent more than the Engineer's Estimate of $4,000,000. This discrepancy appears to reflect the recent upturn in the building construction industry which is resulting in corresponding increases of labor and material cost as well as affording higher profit levels. 2 of Marina Park Project — Bid Package 2 — Award of Contract No. 3897 -B (CAP09 -0070) December 10, 2013 Page 3 Pursuant to the contract specifications, the contractor will have 140 consecutive working days to complete the Bid Package 2 construction work. ENVIRONMENTAL REVIEW: The Final Environmental Impact Report for the Marina Park Project was adopted by City Council on May 11, 2010. No additional environmental clearances are required. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
