TITLE: Corona del Mar Pocket Park — Adoption of a Resolution Delegating Authority to the City Manager to Execute all Documents Necessary to Accept Real Property (CAP14 -0026) ABSTRACT: The City desires to accept a portion of real property from the owner of the property located at 3140 East Coast Highway for the purposes of constructing a new City Pocket Park. A Resolution is required in order to delegate authority to the City Manager to execute all necessary documents and agreements related to the acceptance of real property. RECOMMENDATION: Adopt Resolution 2014 - 2 delegating authority to the City Manager to execute all documents and agreements necessary and appropriate to accept real property for the new City Pocket Park. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The property owner at 3140 East Coast Highway ( Hobie Surf Shop) has expressed interest in donating a portion of their real property to the City of Newport Beach for the construction of a new Pocket Park. This proposed Pocket Park is located just north of the Hobie Surf Shop and will be approximately 1,300 square feet. Refer to Attachment A for the location of the proposed Pocket Park. Planned park features include terraced, drought tolerant landscaping, irrigation system, low block retaining walls, bench seating, walkway, and up- lights for the existing adjacent Hobie wall mural. The conceptual plan for the park was shared with and approved by the Parks, Beaches and Recreation Commission on I of 4 Corona del Mar Pocket Park — Adoption of a Resolution Delegating Authority to the City Manager to Execute all Documents Necessary to Accept Real Property January 14, 2014 Page 2 November 5, 2013. Staff is currently developing final construction documents for this Pocket Park and will begin construction after securing the necessary real property. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Resolution 2 of CORONA DEL MAR POCKET PARK LOCATION MAP Attachment A ED COM PJ� CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT C -5042 1 1/14/2014 3 of ATTACHMENT B RESOLUTION NO. 2014 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DELEGATING AUTHORITY TO THE CITY MANAGER TO EXECUTE ALL DOCUMENTS AND AGREEMENTS RELATED TO THE ACCEPTANCE OF REAL PROPERTY FOR THE CORONA DEL MAR POCKET PARK PROJECT WHEREAS, the City Council of the City of Newport Beach desires to construct the Corona del Mar Pocket Park located at or adjacent to 3140 East Coast Highway as identified in the Fiscal Year 2013 -2014 Capital Improvement Program; and WHEREAS, the City Council of the City of Newport Beach desires to accept real property for the purposes of constructing the Corona del Mar Pocket Park; and NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the City Manager of the City of Newport Beach is hereby authorized, on behalf of the City, to sign all documents and agreements necessary and appropriate to carry out and implement this Resolution including any agreements or certificates of acceptances necessary to acquire the real property.
