Brown, City Clerk APPROVED: � A TITLE: APPOINTMENT OF MEMBER TO THE CORONA DEL MAR BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD ABSTRACT: California Streets and Highways Code Sections 36500 et seq., grants the City Council the authority to appoint an advisory board for Business Improvement Districts formed under the Parking and Business Improvement Area Law of 1989. At its June 25, 2013 meeting, the City Council appointed six of seven members to the Corona del Mar Business Improvement District's ( "BID ") advisory board. The City Council is now presented with the opportunity to appoint the seventh member of the BID's advisory board. RECOMMENDATION: Appoint Ms. Jessica Prause, representing The Port Theater, to the BID's advisory board for Fiscal Year ( "FY ") 2013 -2014. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: At the Regular Meeting of June 25, 2013, the City Council appointed six members to the BID's advisory board for FY 2013 -2014. Although the City Council appointed six members to the advisory board at this meeting, the BID's bylaws allow for up to seven members. The June 25, 2013 staff report noted that it was staff's intent to return to the City Council with an additional appointment. APPOINTMENT OF A MEMBER TO THE CDM BID ADVISORY BOARD January 14, 2014 Page 2 Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk prepared and posted a Notice of Vacancy on Thursday, October 17, 2013 in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Notice was also placed on the City's webpage on Thursday, October 17, 2013, and was published in the Daily Pilot on Saturday, October 19, 2013. As per the Notice, applications were accepted by the City Clerk's Office until 4:00 p.m. on Tuesday, October 29, 2013. The BID's advisory board met on December 5, 2013, and voted to recommend that the City Council appoint Ms. Jessica Prause, representing The Port Theater, to the advisory board. The Port Theater is a member in good standing with the BID. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
