HomeMy WebLinkAbout84-5 - Vacate Sewer Easements on Clay StreetRESOLUTION NO. 84 -5 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING C:ITY'S INTENTION TO VACATE TWO 5 FT. WIDE SEWER EASEMENTS LOCATED NORTHERLY OF CLAY STREET AT SNUG HARBOR AND AT PIRATE ROAD; ACCEPTING A MAE, SHOWING THE PORTION PROPOSED TO BE VACATED; AND SETTING FEBRUARY 13, 1984, AS THE DATE FOR A PUBLIC HEARING CONCERNING THE INTENDED VACATION (DWG. #5475 -L) WHEREAS, the provisions of the Street Vacation Act and all amendments thereto, being Section 8300 to 8325 and 8340 to 8353 inclusive, of the Streets and Highways Code of the State of California, provide for the vacation of easements; and WHEREAS, on June 24, 1982, the Planning Commission of the City of Newport Beach conditionally approved Resubdivision 723 which was also reviewed and approved on September 27, 1982 by the City Council of the City of Newport Beach; and WHEREAS, in obtaining approval of Resubdivision 723, Saint Andrews Presbyterian Church (the developer), desired to relocate two existing 5 Ft. wide sewer easements, to accommodate its own development of the real property for church property; and WHEREAS, as a condition of approval of Resubdivision 723, Saint Andrews Presbyterian Church agreed to relocate the City's existing sewer facilities located within the subject easements at its own expense; and WHEREAS, the existing sewer facilities within the subject easements have been relocated with the approval of City staff and the City staff has determined that there is no future need or use for the subject easements; and • WHEREAS, the area to be vacated is legally described on Exhibit "A" hereto and depicted on a map attached hereto as Exhibit "B" both incorporated herein by reference; and WHEREAS, proceedings for the vacation of the above described easements shall be undertaken by the City of Newport Beach pursuant to the provisions of the Street Vacation Act of • 1941 and all amendments thereto, being Sections 8300 and 8325 and 8340 to 8353 inclusive, of the Streets and Highways Code of the State of California; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that notice is hereby given and that the City Council does hereby fix February 13, 1984 at the hour of 7:30 p.m. of said day, in the City Council Chambers of the.City of Newport Beach, located at 3300 Newport Boulevard, Newport Beach, California, as the time and place for hearing all persons interested in or objecting to the proposed vacation of said easements, and the City Council at said time and place will hear the evidence offered by any person interested in the vacation of said easements herein described. BE IT FURTHER RESOLVED that this Resolution of Intention shall be published at least once in the official newspaper of the City, and said publication shall be made before the date set for the hearing of all persons interested in or objecting to the proposed vacation.
