• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING COUNTY COUNSEL
FOR THE COUNTY OF ORANGE TO REPRESENT THE CITY
OF NEWPORT BEACH IN LITIGATION COMMENCED BY
SAVON DRUGS TO RECOVER PROPERTY TAXES
WHEREAS, Savon Drugs, Inc., has commenced litigation in
the Orange County Superior Court against the County of Orange,
City of Newport Beach, and other Orange County cities, seeking
the recovery of property taxes; and
WHEREAS, pursuant to the provisions of Section 5149 of
the Revenue and Taxation Code, a City may authorize County
counsel to act on its behalf with respect to litigation seeking
the recovery of property taxes; and
WHEREAS, the City will reimburse County of Orange for
its proportionate share of the attorney's fees incurred in
defending the interests of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the County counsel for the County
of Orange is hereby authorized to represent the interests of the
City of Newport Beach in litigation commenced by Savon Drugs,
Inc. (Orange County Superior Court Case No. 42- 33 -48);
BE IT FURTHER RESOLVED that the City of Newport Beach
shall reimburse the County of Orange for its proportionate share
of the attorney's fees incurred in the defense of the interests
of the City of Newport Beach, with the City's share to be
calculated by dividing the revenues attributable to the City of
Newport Beach by the total sum at issue in the litigation.
