HomeMy WebLinkAbout85-20 - Assembly Bill 1543 - Fines & ForfeituresRESOLUTION NO. 85 -20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH OPPOSING ASSEMBLY BILL NO. 1543 (ROBINSON) REGARDING AN INCREASE IN PERCENTAGE OF FINES R FORFEITURES TO BE RETAINED BY THE COUNTY OF ORANGE • WHEREAS, under existing law, the County of Orange presently retains Fifteen Percent (15 %) of the fines and forfeitures paid to Municipal courts by persons cited for violating Municipal parking ordinances; and WHEREAS, municipalities perform almost all of the work related to the issuance and processing of Municipal Parking Citations; and WHEREAS, the work performed by Municipal courts in conjunction with the collection of fines and forfeitures constitutes less than Fifteen Percent (15 %) of all work required to issue, process and collect the fines and forfeitures paid as a result of Municipal parking citations; and WHEREAS, AB 1543, which proposes a Five Percent (5 %) in the percentage of fines and forfeitures to be retained by the County of Orange, is not warranted by the work performed by the courts in collecting parking fines and forfeitures and not an appropriate method of funding construction of courts and related facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach is opposed to AB 1543 which proposes a Five Percent (5 %) increase in the funds the County of Orange is entitled to retain as a result of fines and forfeitures derived from Municipal parking citations; and • BE IT FURTHER RESOLVED that existing law, which entitles the County to retain Fifteen Percent (15 %) of the fines and forfeitures derived from Municipal parking citations, more than fully compensates the County for the costs of services performed by the courts in* collecting the fines and forfeitures.
