HomeMy WebLinkAbout85-42 - Police Department Management SurveyRESOLUTION NO. 85 -42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN AN AGREEMENT WITH THE NATIONAL LEAGUE OF CITIES REGARDING A POLICE DEPARTMENT MANAGEMENT SURVEY WHEREAS, the City Council of the City of Newport Beach has determined that it is appropriate to conduct a management and operational study of the Police Department of the City of Newport Beach; and WHEREAS, the National League of Cities has submitted a proposal to conduct such a study and has competently and successfully performed similar studies for cities in other jurisdictions; and WHEREAS, the National League of Cities has submitted a Work Agreement (attached as Exhibit "A ") which reflects the scope of the work to be performed by the National League of Cities, and accurately and thoroughly reflects the nature of the study desired by the City Council, and has been approved as to form by the City Attorney. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Mayor and City Clerk are hereby authorized to execute the Work Agreement (Exhibit "A"); BE IT FURTHER RESOLVED that the City Manager is hereby authorized to advise the National League of Cities of the City Council's approval of this Agreement. (All Mayor City Clerk RSP /Police POLICE MANAGEMENT SURVEY (Focused, with Fo ow -Up) WORK AGREEMENT: NEWPORT BEACH, CALIFORNIA This Agreement is made and entered into by and between the City of • Newport Beach, California, hereinafter referred to as the "City," and the National League of Cities, hereinafter referred to as the "League." WITNESSETH: 1. The League, for and in consideration of the covenants herein- after set forth and the compensation to be paid to the League as hereinafter specified, agrees to conduct a management and operational study of the Police Department of the City of Newport Beach. It is agreed that the study will include in -depth analysis and recommendations in the following areas: a. Overview of Police Workload and Resources. A general examination of crime and other police workload factors, police manpower and material resources, and community characteristics. Including trends in major crime, crime clearances, traffic accidents, and calls for police ser- vice. Comparison of the Newport Beach Police Department with departments of selected similar cities. This aspect of the survey is intended to provide an overview Page 2 of 9 of the Police Department and community in which it operates, with emphasis on gross workload trends over • time and related trends in police resource allocation. It is descriptive and comparative and focuses on overall major police problems and :responses rather than specif- ics of internal organization and procedure. b. Organization and Resource Allocation. An assessment of the present manpower utilization of the Newport Beach Police Department including allocation and distribution of manpower by time, function, and area. A recommended optional resource allocation plan will be provided to the extent that supporting data are available. Organi- zational structure will be reviewed as it relates to manpower utilization and, if appropriate, a recommended reorganization plan will be provided. Alternatives to personnel increases will be identified wherever possi- ble, including opportunities for productivity gains. C. Personnel Practices. An examination of personnel prac- tices, policies, and procedures as they affect the Newport Beach Police Department. Including recruiting, selection, training, promotion, evaluation, classifica- tion, pay, discipline and labor relations. Assessment 1 \v Page 3 of 9 of employee opinion regarding work related conditions through use of in -depth interviews with a stratified random sample of at least 20 percent of Department employees. d. Management and Administration. Management and admini- strative policies and procedures to include planning, direction, and supervision, internal inspection and control fiscal management, public information, liaison with criminal justice agencies and information systems applications. A review of field reporting systems and recommendations for improvements in cost - effectiveness and accuracy. e. Field Operations. Organization, patrol deployment and scheduling of the patrol force, as well as patrol methods and techniques. Traffic and special patrol operations. Criminal investigations, including organi- zation, operations, case management, intelligence and informant control, evidence and special equipment. Juvenile investigations and the selection, training, and evaluation of investigation. Page 4 of 9 f. Intra- Government Relations. A review of the traditional and statutory basis for the relationships between the Office of the Chief of Police and other significant City officials, to identify actual or potential relationship problems and, where appropriate, recommending guidelines that reflect the legitimate interests and responsibili- ties of all parties. 2. It is further agreed that this study will require at least some degree of informal review of almost all aspects of police department operations. While the methods and results of such functions as personnel administration, command and control, field operations, communications, records, and support activities are not the primary focus of this study, any observed potential for improving productivity and the delivery of police services in these areas will be noted and reported. 3. The League agrees to begin this project within thirty (30) days of the date the League receives an executed copy of this Agreement or as soon thereafter as is mutually agreeable to the City and the League, and will complete the survey within six (6) months of the date of the commencement of the field work. The League agrees that the work effort in production of this study shall include not less than thirty (30) staff days on • site in Newport Beach in addition to whatever off -site analy- sis and report preparation time is required. 5. The League agrees to prepare and deliver to the City Manager of the City of Newport Beach twelve (12) copies of the report reflecting the results of this study and presenting recommen- dations for improvements. This report will be delivered within six (6) months of the initiation of the field work. The League further agrees to provide, on request by the City, the services of one of its consultants for a period of time necessary for oral presentation of the report in Newport Beach. 6. The League agrees to provide, on request by the City and at no cost to the City other than travel and subsistence for one consultant, a total of five (5) site days of consultation on one occasion during the twelve (12) month period subsequent to the date of the delivery of the survey report. The League will conduct the study, prepare and deliver all reports, make an oral presentation, and provide five site • days of follow -up assistance at a cost of Sixty Thousand Dollars ($60,000) to be paid to the League by the City as follows: a» Upon execution of this Agreement, the sum of Twenty Thousand Dollars ($20,000) shall be due and payable to the League by the City. b. Thirty days after the date of the commencement of the field work on this project, the sum of Twenty Thousand Dollars ($20,000) shall be due and payable to the League by the City. C. Upon delivery of the survey report, the remaining sum of Twenty Thousand Dollars ($20,000) shall be due and payable to the League by the City. Such payments are to be made to the League within twenty (20) days of the receipt of the invoices by the City. 8. The League agrees that as part Of this consulting service, it will continue to provide advice, counsel, and suggestions relative to the study and its implementation to the City of E Page 7 of 9 Newport Beach for a period of twelve months following deliv- ery of the report. This service is without cost for tele- phone or letter contacts. Field visits, in addition to those provided for under Paragraph 6 of this Agreement, will be provided as requested by the City at a cost of Eight Hundred Dollars ($800) a day plus transportation and other actual direct expenses. 9. So that the League may perform its part of this Agreement, the City agrees to provide the League with all information, access to files and records, and use of its institutional facilities which may be necessary to perform properly the League's obligations hereunder. The City agrees to provide motor vehicle transportation within California as may be necessary to conduct this study. 10. It is understood and agreed that the City will provide one or more mid -level police personnel of the City, as required, to assist in the study as needed in the collection and evalua- tion of data under the direction of an assigned consultant of the League. 11. Neither the League nor any employee of the League participat- ing in the study will be deemed an employee of the City. The Page 8 of 9 selection and designation of the personnel of the League to participate in this study shall be made by the League with • initial approval by the City and in all other respects the League will act in the capacity of an independent contractor and shall not act under the direction or control of the City or any of its officials or employees. Execution of this Agreement by the City of Newport Beach shall constitute acceptance and approval of all personnel for whom resumes have been previously submitted by the League to the City. 12. The League shall not, in the performance of this Agreement, discriminate against any person because of his or her race, sex, or political or religious opinions or affiliations. 13. The City will indemnify and hold harmless the League from all claims, demands, and suits that may be brought or filed against the League by anyone as a result of the distribution by the City to third persons of any reports or recommen- dations furnished to it by the League. The League will not release working papers, information, or reports concerning the study of the City's Police Department except by written request of the City Manager of the City of Newport Beach.
