HomeMy WebLinkAbout85-63 - Senate Bill 1434 - Fair Labor Standards Act of 1938r 1 LJ RESOLUTION NO. 85 -63 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SUPPORTING THE PASSAGE OF SENATE BILL S 1434 AMENDING THE FAIR LABOR STANDARDS ACT OF 1938 WHEREAS, a United States by Senator Pete Wilson, and cosil Lugar, Durenberger, Symms and Standards Act of 1938 to exclude political subdivisions of states relating to maximum hours; and Senate Bill, S 1434, authorized ;ned by Senators Thurmond, Garn, Exon, amends the Fair Labor the employees of the states and from the provisions of the Act WHEREAS, the United States Senate is concerned about protecting state's rights guaranteed under the Tenth Amendment of the United States Constitution; and WHEREAS, the United States Supreme Court imposed the provisions of the Fair Labor Standards Act of 1938 upon state and local governments in apparent disregard to state's rights guaranteed under the Tenth Amendment of the United States Constitution; and WHEREAS, the immediate financial impact of compliance to the Fair Labor Standards Act for the City of Newport Beach will add hundreds of thousands of dollars of unnecessary costs annually to maintain and operate normal city facilities and services; and WHEREAS, the imposition of these regulations and their • accompanying costs threaten the continuity and quality of service provided by the City of Newport Beach to its residents and visitors; and -1- WHEREAS, the City of Newport Beach wishes to communicate its support of Senate Bill S 1434, and restore the state's rights previously guaranteed under the United States Constitution. • NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach does hereby support Senate Bill S 1434 to amend the Fair Labor Standards Act of 1938 to exclude the employees of states and political subdivisions of states from the provisions of the Act relating to maximum hours.
