RESOLUTION NO. 85 -80
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING CITY'S INTENTION TO
VACATE AN ALLEY NORTHERLY OF EAST BAY AVENUE
BETWEEN PALM STREET AND ADAMS STREET AND
SETTING A DATE FOR PUBLIC HEARING
WHEREAS, the City Council of the City of Newport Beach
intends to vacate an unnamed alley, located northerly of East Bay
Avenue, between Palm Street and Adams Street; and
WHEREAS, the precise location of the alley to be
abandoned is depicted on drawing number R /W- 5493 -L, prepared by
the Public Works Department, City of Newport Beach, attached as
Exhibit "A," and incorporated in this Resolution by reference;
and
WHEREAS, abandonment of the subject alley was a
condition of approval to Resubdivision 797 (Bayview Landing
Project); and
WHEREAS, the City Council of the City of Newport Beach
has considered the various elements; of the General Plan of the
City of Newport Beach prior to declaring its intent to vacate the
alley; and
WHEREAS, it is the intent of the City Council to
reserve, and accept from the vacation, the public service
easement over, on and under the alley; and
WHEREAS, the proposed vacation is conducted pursuant to
• the provisions of the Public Streets, Highways, and Service
Easements Vacation Law (Sections 8300, et seq. of the Streets &
Highways Code of the State of California).

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the time and place for hearing all
• persons interested in, or objecting to, the proposed vacation of
the alley depicted on Exhibit "A" shall be 7:30 P.M., or as soon
thereafter as the matter may be heard, October 28, 1985, in the
Chambers of the City Council of the City of Newport Beach located
at 3300 Newport Boulevard, Newport Beach, California.
BE IT FURTHER RESOLVED that this Resolution of Intention
shall be published for at least two (2) successive weeks prior to
the hearing in the official newspaper of the City of Newport
Beach.
BE IT FURTHER RESOLVED that Notices, stating the day,
hour and place of the hearing, the adoption of the Resolution of
Intention, and a description of the easement proposed to be
vacated shall be posted not more than three hundred (300) feet
apart and at least three (3) notices shall be posted along the
alley.
