• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH VACATING AND ABANDONING A PORTION
OF THE SEWER EASEMENT THROUGH PROPERTY LOCATED AT
1011 AND 1021 KINGS ROAD

WHEREAS, on September 23, 19859 the City Council of the
City of Newport Beach, adopted Resolution Number 85 -79 declaring
its intention to vacate and abandon a portion of a sewer easement
through 1011 and 1021 Kings Road and setting October 15, 1985 for
the date of the public hearing on the proposed abandonment; and
WHEREAS, notice of the proposed abandonment has been
given by the City as provided in Sections 8322 and 8323 of the
Streets and Highway Code; and
WHEREAS, on October 15, 19859 the City Council conducted

a public hearing and received evidence offered by all persons
interested in the proposed abandonment; and
WHEREAS, the City Council of the City of Newport Beach
has considered the various elements of the General Plan of the
City of Newport Beach and its decision to vacate the sewer
easement; and
WHEREAS, the City Council finds, from all evidence
submitted, that the sewer easement described in the Resolution of
Intention and the drawing attached to this Resolution as Exhibit
"A," is unnecessary for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Newport Beach, that:

1. The sewer easement described in Resolution Number
85 -79 and depicted on Exhibit "A," is hereby vacated and
abandoned pursuant to the provisions of the Public Streets,
Highways and Service Easements Vacation Law (Section 8300, et
40 seq. of the Streets & Highways Code of the State of California).
2. That the City Clerk shall cause a certified copy of
this Resolution of Vacation, attested by the Clerk, under seal,
to be recorded without acknowledgement, certificate of
acknowledgement or further proof in the Office of the Recorder of
Orange County.
ADOPTED this 15th day of October , 1985.
