P.Oe R@$ b760 6 aa4y q 8fr369945 ®ED IN OFRCiAL R OF ORANGE COUNTY, CALWORNIA ®9 3® PM AUG 19'86 RESOLUTION NO.. 85 -85 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH VACATING AND ABANDONING AN ALLEY LOCATED BETWEEN EDGEWATER PLACE AND EAST BAY AVENUE AND ADAMS STREET AND PALM STREET (BALBOA AREA) WHEREAS, on September 23, 1985, the City Council of the City of Newport Beach, adopted Resolution Number 85 -80 declaring its intention to vacate and abandon an unnamed alley, located northerly of East Bay Avenue, between Palm Street and Adams Street and setting October 28, 1985 for the date of the public hearing on the proposed abandonment; and WHEREAS, notice of the proposed abandonment has been given by the City as provided in Sections 8322 and 8323 of the Streets and Highway Code; and WHEREAS, on October 28, 1985, the City Council conducted a public hearing and received evidence offered by all persons interested in the proposed abandonment; and WHEREAS, the City Council of the City of Newport Beach has considered the various elements of the General Plan of the City of Newport Beach and its decision to vacate the alley easement; and WHEREAS, the City Council finds, from all evidence submitted, that the alley described in the Resolution of Intention and the drawing attached to this Resolution as Exhibit "A," is unnecessary for present or prospective public use. NOW, THEREFORE, BE IT RESOLVED, by the City the City of Newport Beach, that: -I- I of .0 86 :36994.5 1. The alley easement described in Resolution Number 85 -80 and depicted on Exhibit "A," is hereby vacated and abandoned pursuant to the provisions of the Public Streets, Highways and Service Easements Vacation Law (Section 8300, et seq. of the Streets & Highways Code of the State of California). 2. Pursuant to the provisions of Section 8340 of the Streets & Highways Code of the State of California, the City Council reserves and excepts from the vacation the right to maintain, operate, replace or renew existing public utility facilities, and the right to, at any time, and from time to time, construct, maintain, operate or replace sanitary sewers, storm drains, or lines of pipe, conduit, cable, wires, poles or other structures, equipment or fixtures for the transportation, transmission, or distribution of electric wiring, water, oil, gas or telephonic messages. 3. That the City Clerk shall cause a certified copy of this Resolution of Vacation, attested by the Clerk, under seal, to be recorded without acknowledgement, certificate of acknowledgement or further proof in the Office of the Recorder of Orange County. ADOPTED this 28th day of October , 1985.
