A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING CITY'S INTENTION TO
VACATE AND TO SET A PUBLIC HEARING TO CONSIDER
THE VACATION OF, A PORTION OF THE SEWER
• EASEMENTS WITHIN "MACARTIIUR COURT," RESUB-
DIVISION NO. 786 AND SETTING A DATE FOR PUBLIC
HEARING
WHEREAS, the City Council of the City of Newport Beach
intends to vacate a portion of the existing sewer easements
within "MacArthur Court," located at 4655 Birch Street and the
northerly corner of Birch Street and MacArthur Boulevard in the
Koll Center Newport Planned Community; and
WHEREAS, the precise location of the sewer easements to
be vacated and abandoned are described on a Description Form, a
copy of which is attached as Exhibit "A," and the sewer easements
are depicted on a map prepared by the Public Works Department of
the City of Newport Beach, a copy of which is attached as Exhibit
"B;" and
WHEREAS, the City Council has reviewed and considered
all provisions of the City's General Plan pertaining to the
location of the easement to be abandoned and finds the proposed
abandonment is consistent with the provisions of the General Plan
and related City ordinances, policies and rules;
WHEREAS, the proposed vacation is conducted pursuant to
the provisions of the Public Streets, Highways, and Service
Easements Vacation Law (Sections 8300, et seq. of the Streets &
Highways Code of the State of California).
• NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the time and place for hearing all

persons interested in, or objecting to, the proposed vacation of
the sewer easement described as that portion of Parcel 4 as shown
• on a Map Filed in Book 196, Pages 40, 41, 42 and 43 of Parcel
Maps, in the Office of the County Recorder shall be 7 :30 P.M., or
as soon thereafter as the matter may be heard, February 9, 1987,
in the Chambers of the City Council of the City of Newport Beach
located at 3300 Newport Boulevard, Newport Beach, California.
BE IT FURTHER RESOLVED that this Resolution of Intention
shall be published for at least two (2) successive weeks prior to
the hearing in the official newspaper of the City of Newport
Beach.
BE IT FURTHER RESOLVED that Notices, stating the day,
hour and place of the hearing, the adoption of the Resolution of
Intention, and a description of -the easement proposed to be
vacated shall be posted not more than three hundred (300) feet
apart and at least three (3) notices shall be posted along the
street.

Those certain easements for the construction, operation, maintenance
and repair of sanitary sewers and appurtenances over, under, along and
through that portion of Parcels 1, 2, 3 and 4, in the City of Newport
Beach, County of Orange, State of California, as shown on the map filed
in Book 196, pages 40, 41, 42 and 43 of Parcel Maps, in the office of
the County Recorder of said County, included within strips of land,
10.00 feet in width, the centerlines of said strips being described as
follows:
Easement "A"
Commencing at the Southwesterly terminus of that certain course shown
as "North 40 038'26" East 59.64 feet" and described in a deed to the
City of Newport Beach, recorded August 6, 1981 in Book 14172, Page 604
of Official Records in the office of said County Recorder; thence
North 40 038'26" East 59.64 feet along said certain course to the TRUE
POINT OF BEGINNING; thence North 75 002'07" East 180.62 feet; thence
North 40 038'32" East 272.38 feet; thence North 4 035'30" West 262.39 feet.
Easement "B"
Commencing at the Southwesterly terminus of that certain course shown as
"North 40 038'26" East 59.64 feet" and described in a deed to the City of
Newport Beach, recorded August 6, 1981 in Book in Book 14172, Page 604
of Official Records in the office of said County Recorder; thence North
40 °38'26" East 59.64 feet along said certain course; thence North 13 °07'54"
East 76.84 feet along said certain course to the TRUE POINT OF BEGINNING;
thence North 24 031'25" East 216.25 feet; thence North 43 °13'26" East
326.97 feet.

a part hereof.
