HomeMy WebLinkAbout87-23 - Amendment 643-Pacific Mutual Financial PlazaRESOLUTION NO. 87 -23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING AMENDMENT NO. 643, AN AMENDMENT TO THE PLANNED COMMUNITY DEVELOPMENT STANDARDS SO AS TO INCREASE THE MAXIMUM ALLOWABLE OFFICE FLOOR AREA IN AREA 1 (PACIFIC MUTUAL FINANCIAL PLAZA) OF THE BLOCK 800 • PLANNED COMMUNITY DISTRICT IN NEWPORT CENTER. WHEREAS, Section 20.51.045 of the Newport Beach Municipal Code provides that final amendments to a Planned Community Development Plan must be approved by a Resolution of the City Council, setting forth full particulars of the amendment; and WHEREAS, the Planning Commission conducted a duly noticed public hearing on January 8, 1987, at which time it considered an amendment to the Planned Community Development Standards for the Block 800 Planned Community District in Newport Center so as to permit the development of an additional ±2,740 sq.ft. of office floor area in Area 1 (Pacific Mutual Financial Plaza) of the Planned Community; and WHEREAS, at said public hearing the Planning Commission adopted Resolution No. 1153, recommending to the City Council that an amendment to the Planned Community Development Plan for the Block 800 Planned Community District in Newport Center, as set forth in the Planning Commission minutes of the January 8, 1987 meeting, be adopt- ed; and WHEREAS, the property owner has required an amendment to the Planned Community Development Standards so as to permit expansion of the existing land use; and WHEREAS, it has been determined that the proposed expansion of the existing land use will not adversely effect the adjoining properties; and WHEREAS, the City Council has conducted a duly noticed public hearing on the proposed amendment in accordance with all ® provisions of the law; and WHEREAS, the City Council finds and determines that said amendment to the Planned Community Development Standards for the Block 800 Planned Community District in Newport Center, as set forth in Exhibits "A" and "B" attached hereto, is desirable and necessary. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby approves the proposed amendment to the Planned Community Development Standards for the Block 800 Planned Community District in Newport Center, as set forth in Exhibits "A" and • "B" attached hereto. Area Two The criteria for and design of development of Area Two will be developed at a subsequent date and will be set forth in a site development plan which will be reviewed and approved by the City of Newport Beach. 3. Intensity of Developed Areas A. Area One 1. Maximum floor area for commercial, profes- sional, institutional and business office uses: 288TS59 291,590 gross sq.ft. SR18 • EXHIBIT "E" FINDINGS AND CONDITIONS OF APPROVAL AMENDMENT NO. 643 is Findings: 1. That the proposed uses are consistent with the Land Use Plan/Element of the General Plan, the Block 800 Planned Community Development Standards, and are compatible with the surrounding land uses. 2. That it has been determined that the requested amendment (NO. 643) to the Block 800 Planned Community Development Standards is appropriate, and that both the existing and proposed uses of the land will not conflict with any of the pol- icies or ordinances of the City of Newport Beach. 3. That the proposal is consistent with the existing use of the subject property and that this develop- ment is a logical use of the property that would be precluded under the development limits set by the existing Planned Community Standards. 4. That the requested amendment for the subject property will not adversely impact upon the parcel's surroundings and that the granting of Amendment No. 643 will not be detrimental or injurious to persons, property, and improvements in the neighborhood or general welfare of the City, and further, that the applicant's request would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code. 5. That the City Traffic Engineer has reviewed and preliminarily approved the proposed parking lot design. 6. That, as a multi- tenant office plaza, provision of adequate parking to service the needs and require- ments of the tenants is reasonable and necessary as provided by Title 20, Chapter 20.30.035, Section C of the Newport Beach Municipal Code. 7. That the proposed percentage of compact, tandem, and handicapped spaces is reasonable for the demand upon the total number of the parking spaces upon the site, and shall not exceed the maximum of twenty -five percent (258) and two percent (28) for handicapped persons of the total off - street • parking spaces provided on -site as established by the Block 800 Planned Community Development Standards. B. That the project coriplies with the requirements of the California Environmental Quality Act. 9. That the project will not have any significant isenvironmental impacts. CnnAiYinnce 1. That development shall be in substantial confor- mance with the approved plot plan and floor plan except as may be noted below. 2. That all improvements be constructed as required by ordinance and the! Public Works Department. 3. That the final development plans be reviewed by the Building, Fire, and Planning Departments before the issuance of any building permits. 4. That applicant shall submit a revised, fully dimensional plan of all parking areas for review and approval by the Traffic Engineer and Planning Department. 5. That the on -site parking, vehicular circulation and pedestrian circulation systems be subject to further review by the Planning Department and Traffic Engineer; that the parking plan be ap- proved by City staff prior to the issuance of building permits. Handicap parking shall be provided in accordance with Title 24 of the City's Municipal Code. 6. That the minimum number of off - street parking spaces as required by Title 20, Chapter 20.30.035, Section C of the Newport Beach Municipal Code be provided, and further that the number of spaces provided for compact cars not exceed twenty -five percent (258) and two percent (28) for handicapped persons. 7. That all provisions of the Uniform Building, Plumbing, and Electrical Codes, and all local amendments be incorporated into the final project plans unless otherwise approved by the City Building Director.
