HomeMy WebLinkAbout87-37 - Hazardous Materials Release Response PlanRESOLUTION NO. 87 -37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ASSUMING RESPONSIBILITY FOR IMPLEMENTATION OF LAWS PERTAINING TO HAZARDOUS MATERIALS RELEASE RESPONSE PLANS • WHEREAS, the state legislature has found that, in order to protect the public health, safety and the environment, it is necessary to establish business and area plans related to the handling and release, or threatened release, of hazardous materials, and has established minimum standards for content of these plans; and WHEREAS, the business and area plans would provide basic information on the location, type, quantity, and health risks of hazardous materials handled, used, stored or disposed of in the state, which could be accidentally released into the environment, and this information is not now available to firefighters, health officials, planners, regulatory agencies and other interested persons; and WHEREAS, responsibility for the implementation of Chapter 6.95 of Division 20 of the Health & Safety Code of the State of California may be assumed by a City pursuant to ordinance or resolution, and, once assumed, the City has exclusive jurisdiction within its corporate limits to administer and implement those provisions of state law relative to hazardous materials release response plans; and WHEREAS, the City Council of the City of Newport Beach wishes to assume this responsibility pursuant to Section 25502 of the Health & Safety Code, and intends to designate the Fire • Department, which currently enforces regulations affecting the handling, storage and use of hazardous materials as the agency • • within the City responsible for administering hazardous materials release response plans and inventories. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Newport Beach as follows: 1. The City of Newport Beach, pursuant to the provisions of Section 25502 of the Health & Safety Code of the State of California, hereby assumes responsibility for the implementation of Chapter 6.95 of Division 20 of the Health & Safety Code of the State of California and declares that it has exclusive jurisdiction within the boundaries of the City of Newport Beach for the purpose of carrying out the provisions of that chapter; and 2. The City Council hereby designates the Newport Beach Fire Department as the agency responsible for administering and enforcing the provisions of the Health & Safety Code described above; and 3. That the Fire Chief shall immediately notify the Office of Emergency Services of the City Council's designation of that Department as the agency responsible for administering and enforcing the laws described above.
