HomeMy WebLinkAbout88-80 - Rebuttal for General Municipal Election - 11-8-88RESOLUTION NO. 88 -80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS FOR THE MEASURE TO BE SUBMITTED TO THE VOTERS AT THE GENERAL MUNICIPAL ELECTION ON NOVEMBER 8, 1988. WHEREAS, the City Council of the City of Newport Beach has, this date, called and given notice of a General Municipal Election to be held on Tuesday, November 8, 1988; and WHEREAS, the City Council has directed the Traffic Management Initiative be submitted to the voters on that date; and WHEREAS, Sections 4015.5 and 5014.5 of the Elections Code of the State of California authorize the City Council, by majority vote, to adopt provisions for the filing of rebuttal arguments for City measures submitted to the voters at any municipal election. NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve as follows: Section 1. Pursuant to the provisions of Sections 4015.5 and 5014.5 of the Elections Code of the State of California, when the Clerk has selected the arguments for and against the Traffic Management Initiative that are to be printed and distributed to the voters, the Clerk shall send copies of the argument in favor of the measure to the authors of the argument against, and copies of the argument against to the authors of the argument in favor. The authors may prepare and submit rebuttal arguments not exceeding 250 words. The rebuttal argument shall be filed with the City Clerk not more than 10 days after the final date for filing direct arguments. Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal 1 argument shall immediately follow the direct argument which it seeks to rebut. Section 2. All previous resolutions providing for the filing of rebuttal arguments for City measures are hereby repealed. Section 3. The provisions of Section 1 shall apply to the Municipal Election to be held on November 8, 1988 and at each Municipal Election thereafter unless this Resolution is repealed by the City Council of the City of Newport Beach in accordance with the provisions of Section 4015.5 and /or 5014.5 of the Elections Code of the State of California, or other relevant provisions of state or local law. Section 4. The City Clerk shall certify to the passage of this resolution and enter it in the book of original resolutions. ADOPTED this 25th day of ATTEST: / 9 1 Q . City C erk
