HomeMy WebLinkAbout88-93 - Vacation of a Portion of Superior AvenueRESOLUTION NO. ;38- 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION OF A PORTION OF SUPERIOR AVENUE. WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions of the Street Vacation Act (Section 8300 et. seq. of the Streets & Highways Code) is authorized to vacate public easements; and WHEREAS, the City Council of the City of Newport Beach desires to vacate that portion of Superior Avenue depicted on the map attached as Exhibit B, and legally described on Exhibit A, the vacation to be processed pursuant to the provisions of the Street Vacation Act; and WHEREAS, the City Council of the City of Newport Beach has reviewed and considered the various elements of the General Plan of the City of Newport Beach prior to ordering the vacation of this portion of Superior Avenue and has determined that the vacation is consistent with the General Plan; and WHEREAS, the vacation is consistent with, and required by, the provisions of an Agreement between the City of Newport Beach and State of California for the acquisition of right -of -way essential to the prior realignment of Superior Avenue. WHEREAS, the City Council finds, from all the evidence submitted at the September 12, 1988 hearing, that the area to be vacated is unnecessary for present and prospective public street purposes. NOW, THEREFORE, Be It Resolved by the City Council of the City of Newport Beach that the portion of Superior Avenue depicted on the map attached as Exhibit B, and legally described on Exhibit A, is hereby declared vacated. YI BE IT FURTHER RESOLVED that this Resolution is to be recorded by the Orange County Recorder.
