A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING A MORATORIUM ON THE
ISSUANCE OF COMMERCIAL IN LIEU PARKING PERMITS.
WHEREAS, Section 12.44.125 of the Newport Beach Municipal
• Code authorizes the sale of "Commercial In Lieu Parking" permits
as a means of providing off street parking required by the Zoning
Ordinance; and
WHEREAS, the City Council Off Street Parking Committee has
studied the practice of selling "in lieu" permits and concludes
that the program has resulted in intensified use of non conforming
buildings that do not provide adequate on site parking and created
additional demand for parking spaces without increasing the
supply; and
WHEREAS, the Off Street Parking Committee has also
determined, after study, that the current fee for "in lieu"
permits represents a significant subsidy to permittees that is
inequitable in light of the costs incurred by others in providing
off street parking required by the Code; and
WHEREAS, the Off Street Parking Committee has recommended
that the City Council adopt an ordinance which would prohibit the
sale of new "in lieu" permits and, over time, substantially
increase fees charged existing permittees; and
WHEREAS, the City Council believes that important
information on the impacts of abolishing the "in lieu" parking
permit program will be developed during preparation of the
Specific Area Plan for the Central Balboa Business District and
• does not intend to make a decision on the parking permit program
until the Plan is approved; and

WHEREAS, the Council desires to impose a moratorium on the
issuance of "in lieu" permits, pending approval of the Central
Balboa Specific Area Plan, to insure there is no intensification
of uses based upon the "in lieu" program and to avoid potential
hardship on new permittees in the event the program is abolished.
NOW, THEREFORE, BE IT RESOLVED that no permits shall be
issued pursuant to the provisions of Section 12.44.125 of the
Newport Beach Municipal Code until City Council approval of the
Specific Area Plan for Central Balboa and Council action on
Ordinance No. 88 -47.
