HomeMy WebLinkAbout89-21 - Orange County Hazardous Waste Management PlanRESOLUTION NO. 89 -21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH TO APPROVE THE ORANGE COUNTY HAZARDOUS WASTE MANAGEMENT PLAN AND ACCEPT THE ENVIRONMENTAL IMPACT REPORT NO. 490 AS ADEQUATE. • WHEREAS, the State's economy and quality of life are dependent on many products and substances that result in the generation of hazardous wastes; and WHEREAS, these hazardous wastes pose a potential threat to the health and safety of the public and the environment; and WHEREAS, there now exists cost - effective means in reducing the amount of hazardous wastes released to the environment; and WHEREAS, through the Hazardous Waste Management Act of 1986, the land disposal of untreated hazardous wastes will be prohibited after May 1990; and WHEREAS, there has been a shift in the philosophy of waste management techniques to reduce, recycle and treat hazardous wastes; and WHEREAS, in 1985 Newport Beach recognized the problems of hazardous waste management and joined the Southern California Hazardous Waste Management Authority through a joint powers agreement; and WHEREAS, being a member of the Authority, Newport Beach has agreed to be responsible for its fair share of the hazardous waste generated within the City; and WHEREAS, Newport Beach adopted Resolution 87 -36 endorsing the preparation of the Orange County Hazardous Waste Management Plan as required by the Tanner Regulations; and WHEREAS, it has been determined that approval of the plan will not have a significant adverse impact upon the environment; and WHEREAS, the Orange County Hazardous Waste Management Plan provides strategies for effective management of hazardous wastes; and WHEREAS, the Orange County Hazardous Waste Management Plan establishes guidelines for consistency in hazardous waste management throughout the County of Orange and the members of the Southern California Hazardous Waste Management Authority; and WHEREAS, City staff has contacted regional and county staff concerning clarification of the actions that cities will be permitted to take to meet their obligations under the fair share principles; and WHEREAS, regional and county staff have agreed to review the issue and clarify the fair share principles by adding language to the fair share principles giving the cities the same powers as the county; and WHEREAS, the City Council and the Planning Commission have found and determined that the Orange County Hazardous Waste Management Plan is necessary and appropriate in order to adequately govern the management of hazardous wastes; and isWHEREAS, the Planning Commission voted unanimously to recommend approval; and WHEREAS, the City Council has considered the recommendation of the Planning Commission in its decision to approve the Orange County Hazardous Waste Management Plan and accept the Environmental Impact Report No. 490 as adequate. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach approves the Orange County Hazardous Waste Management Plan and accepts Environmental Impact Report No. 490 as adequate.
