A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ADOPTING CODE OF
CIVIL PROCEDURE SECTION 1094.6.
WHEREAS, Code of Civil Procedure sets forth procedures for
• judicial review of administrative decisions of local agencies
suspending, demoting or dismissing an officer or employee,
revoking or denying a permit or license application or denying a
retirement benefit or allowance.
WHEREAS, Code of Civil Procedure section 1094.6(g) states this
section shall be applicable to a local agency only if the
governing body thereof adopts a resolution making this section
applicable.
NOW, THEREFORE, it is hereby resolved by the City Council of
the City of Newport Beach that Code of Civil Procedure section
1094.6 is hereby adopted and to be applied to judicial review of
the administrative decisions of the City of Newport Beach
suspending, demoting or dismissing an officer or employee,
revoking or denying a permit or license application or denying a
retirement benefit or allowance.
