HomeMy WebLinkAbout89-74 - Assessment District 59 - McFadden SquareRESOLUTION NO. 59-74 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, COVERING PRELIMINARY DETERMINATION AND ORDERING THE PREPARATION OF A REPORT ON SAID IMPROVEMENT WHEREAS, the CITY COUNCIL of the CITY OF NEWPORT BEACH, CALIFORNIA, is contem- plating the construction of certain public works of improvement under proceedings &onducted pursuant to the "Municipal Improvement Act of 1913 ", being Division 12 of the Streets and Highways Code of the State of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 59 (MCFADDEN SQUARE) (here- inafter referred to as the "Assessment District "'). NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That certain public works of improvement, together with appurtenances and appurtenant work, including acquisition where necessary, are proposed to be done and made within the boundaries of the Assessment District. In connection therewith, it is found and determined as follows: A. That the specific nature of the proposed works of improvement consists of all the work as shown on the proposed boundary map, as previously approved for this Assessment District. B. That the boundaries of the Assessment District and the lands and properties within the Assessment District proposed to be assessed to pay the coats and expenses of said proposed works of improvement are as shown upon a map of the Assessment District, which map has been heretofore approved and is on file with the trapscript of these proceedings. Said map shall govern for all details as to the extent of the Assessment District. SECTION 3. That the statute under which it is proposed to conduct proceedings is the "Municipal Improvement Act of 1913 ", being Division 12 of the Streets and Highways Code of the State of California, with bonds proposed to be issued as authorized by the "Improvement Bond Act of 1915 ", being Division 10 of said Code. SECTION 4. That this proposed improvement is referred to the SUPERINTENDENT OF STREETS, who is hereby appointed to procure all. necessary information to prepare a #eport on the proposed improvement in the manner and form provided for in Division 4 of the Streets and Highways Code of the State of California, the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ". SECTION 5. That this Resolution and the Report as ordered herein are pursuant to the provisions of said Division 4, and said Report shall have attached to it a copy of this Resolution upon its adoption. SECTION 6. That the works of improvement: as proposed to be constructed under these proceedings generally consist of the construction of the McFadden Plaza •improvements, including sidewalks, planters, :Landscaping, roadway and parking lot improvements, together with appurtenances, including antique style street lights and decorative sidewalks and appurtenances, to serve and benefit properties located within the boundaries of this Assessment District. SECTION 7. That this legislative body does, at this time, intend to make a contribution towards certain of the costs and expenses of the works of improvement, as proposed under these proceedings. Said contribution is estimated to be $881- ,100.00 to pay for certain of the costa and expenses, all as set forth in the Investigation Report as prepared by the Superintendent of Streets.
