HomeMy WebLinkAbout90-36 - General Plan Amendment 89-2D Land Use ElementResolution No. 90 -36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTION OF GENERAL PLAN AMENDMENT 89 -2(D) AMENDING THE LAND USE ELEMENT OF THE NEWPORT BEACH GENERAL PLAN SO AS TO REDESIGNATE PROPERTY LOCATED AT • THE NORTHEASTERLY CORNER 19TH STREET AND WEST BALBOA BOULEVARD FROM "RETAIL AND SERVICE COMMERCIAL" TO "MULTI- FAMILY RESIDENTIAL" USES WHEREAS, as part of the development and implementation of the Newport Beach General Plan the Land Use Element has been prepared; and WHEREAS, said element of the General Plan sets forth objectives, supporting policies and limitations for development in the City of Newport Beach; and WHEREAS, said element of the General Plan designates the general distribution and general location and extent of the uses of land and building intensities in a number of ways, including residential land use categories and population projections, commercial floor area limitations, the floor area ratio ordinances; and WHEREAS, the Land Use and Circulation Elements are correlated as required by California planning law; and WHEREAS, the provisions and policies of the Land Use and Circulation Elements are further implemented by the traffic analysis procedures of the Traffic Phasing Ordinance and the implementation programs of that Ordinance and the Fair Share Traffic Contribution Fee Ordinance; and WHEREAS, pursuant to Section 707 of the Charter of the City of Newport Beach, the Planning Commission has held a public hearing to consider a certain amendment to the Land Use Element of the Newport Beach General Plan; and WHEREAS, the proposed project is compatible with the existing land uses in the Central Newport Beach area; and WHEREAS, the circulation system will not be significantly impacted by the proposed project; and • WHEREAS, the City of Newport Beach prepared a Negative Declaration with supporting Initial Study for the project in compliance with the California Environ- mental Quality Act (CEQA) and the State CEQA Guidelines; and WHEREAS, the City Council has reviewed and considered the information contained in the environmental document in making its decision on the proposed amendment to the Land Use Element of the Newport Beach General Plan. NOW, THEREFORE, BE TT RESOLVED by the City Council of the City • of Newport Beach that an amendment to the General Plan with related provisions and requirements as described below is approved. • 1. That the property located at 1900 West Balboa Boulevard on the northwesterly comer of 19th Street and West Balboa Boulevard, more particularly described as Lot 1 and 2, Block 219, Section A, Newport Beach is reclassified from 'Retail and Service Commercial' to "Multi - Family Residential' use. 2. Page 33 of the Land Use Element of the General Plan is amended as follows: McFadden Square. This area (Commercial Area 14) is bounded by Newport Bay, 19th Street, the Public Beach, the alley between 23rd and 24th Streets, Newport Boulevard and 26th Street. The area is shown Recreation and Marine Commercial, Retail and Service Commercial, Single Family Attached, Two - Family Residential or Multi - Family Residential land use. Multi - Family Residential areas require 1,200 square feet of buildable lot area for each dwelling unit. No subdivision which will result in additional dwelling units is allowed. Two- Family Residential areas require 2,000 sq.ft. of buildable lot area for duplex development. 3. The chart on page 34 of the Land Use Element is also amended to reflect the statistical changes which result from the change in land use. ADOPTED this 23rd day of April, 1990. ATTEST:
