RESOLUTION NO. 90 -45
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
EXECUTION OF AN AGREEMENT REGARDING AN
EXCHANGE OF WATER LINE EASEMENTS BETWEEN
THE CITY AND NEWPORT -MESA SCHOOL DISTRICT
WHEREAS, by an Indenture dated November 1, 1923, recorded
in Book 182, Page 237 of Official Records of Orange County, the City
of Newport Beach was granted an easement to construct and maintain a
water pipe line across a certain parcel of land shown as Easement No.
1 on Exhibit "A" attached hereto, and the City has constructed and
continues to maintain a water pipe across said property pursuant to
said indenture; and
WHEREAS, City desires to construct a new water line in
another location on Newport -Mesa School District property shown as
Easement No. 2 on Exhibit "A" attached hereto; and
WHEREAS, the City is willing to execute a Quitclaim
releasing the City's interest in said Indenture of November 1, 1923;
and,
WHEREAS, the City and the Newport -Mesa School District are
willing to enter into an agreement for the exchanging of water line
easements:
NOW, THEREFORE, BE IT RESOLVED:
1. The above mentioned agreement for exchange of water line
easements is approved, and the Mayor and City Clerk are hereby
authorized to execute the same on behalf of the City.
2. The Mayor and City Clerk are authorized to execute a
Quitclaim Deed conveying the City's interest under said indenture of
November 1, 1923, to the owner or owners of record of the real
property.
