RESOLUTION NO. 90 -55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ESTABLISHING PENALTIES FOR
FALSE ALARMS PURSUANT TO SECTION 5.49.070 OF
THE NEWPORT BEACH MUNICIPAL CODE.
WHEREAS, CHAPTER 5.49 of the Newport Beach Municipal Code
establishes regulations and permit procedures for operation of
Burglary, Robbery & Fire Alarm Systems; and
WHEREAS, Section 5.49.070 provides for payment of penalties
for excessive false alarms; and
WHEREAS, on July 9, 1990, Ordinance Number 90-32 was adopted
to amend Section 5.49.070 to provide that the false alarm penalties
shall be established by resolution of the City Council; and
WHEREAS, the City Council wishes to establish penalties for
excessive false alarm responses by the Fire Department; and
NOW, THEREFORE, be it resolved by the City Council of the City
of Newport Beach as follows:
A. The penalties set forth hereinafter is for a
permittee's third (3rd) false fire alarm within a calendar year:
Seventy -five dollars ($75.00).
B. The penalties set forth hereinafter is for a
permittee's fourth (4th) false fire alarm within a calendar year:
One hundred fifty dollars ($150.00).
C. The penalties set forth hereinafter is for a
permittee's fifth (5th) false fire alarm within a calendar year:
Two hundred dollars ($200.00).
WHEREAS, the City Council wishes to establish penalties for
excessive false alarm responses by the Police Department.
NOW, THEREFORE, be it resolved by the City Council of the City
of Newport Beach as follows:
A. For the third (3rd) false alarm within a calendar
year, permittee shall pay a fifty dollar ($50.00) false alarm
penalty;

B. For the fourth (4th) false alarm within a calendar
year, permittee shall pay a one hundred dollar ($100.00) false
alarm penalty; and
C. For the fifth (5th) and each subsequent false alarm
within a calendar year, the permittee shall pay a one hundred and
twenty -five dollar ($125.00) false alarm penalty.
ADOPTED this 13th day of August , 1990.
