A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, APPROVING AND PROVID-
ING FOR CONTRIBUTION TO PAY CERTAIN COSTS AND
EXPENSES IN AN ASSESSMENT DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF NEWPORT BEACH, CALIFORNIA, has, by
Resolution, declared its intention to authorize the construction of certain works of
• improvement pursuant to the terms and provisions of the "Municipal Improvement Act
of 1913", being Division 12 of the Streets and Highways Code of the State of
California, in a special assessment district known and designated as ASSESSMENT
DISTRICT NO. 59 (McFADDEN SQUARE) (hereinafter referred to as the "Assessment
District"); and,
WHEREAS, the legislative body is desirous at this time of providing a
contribution to pay a portion of the costs and expenses of the work and proceedings;
and,
WHEREAS, pursuant to the provisions of Section 10205 of the Streets and
Highways Code of the State of California, a contribution may be provided to pay a
portion of the costs and expenses at any time prior to the confirmation of the
proceedings on said Assessment District.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That the appropriation of the monies as set forth as a contribution
in the Engineer's "Report" as herein presented relating to the above referenced
Assessment District is hereby approved and authorized. Said contribution shall be
used to pay for the items of work as set forth in said Engineers "Report" and the
appropriation shall be from the funds as indicated therein.
SECTION 3. That said contribution is authorized pursuant to Section 10205 of
the "Municipal Improvement Act of 1913 ", being Division 12 of the Streets and
Highways Code of the State of California.
