HomeMy WebLinkAbout91-5 - Vacation of Various Areas in CityRESOLUTION NO. 91 -5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING CITY'S VACATION OF A PORTION OF LAFAYETTE AVENUE AT 26TH STREET, A PORTION OF 26TH STREET WESTERLY OF LAFAYETTE AVENUE AND VACATE A PORTION OF A 40 FOOT WIDE EASEMENT ( LAFAYETTE AVENUE RIGHT -OF -WAY ABANDONED) FOR GAS LINE, SANITARY SEWER AND WATER LINES BETWEEN 26TH STREET AND 28TH STREET IN THE BALBOA PENINSULA AREA • WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions of the Street Vacation Act (Section 8300 et sue. of the Streets & Highways Code) is authorized to vacate public easements; and WHEREAS, the City Council of the City of Newport Beach has reviewed and considered the various elements of the General Plan of the City of Newport Beach prior to declaring its intent to vacate these portions of streets and utilities easement and has determined that the proposed vacation is consistent with the General Plan. WHEREAS, the City Council of the City of Newport Beach held a public hearing on the proposed vacation of these portions of streets and utilities easement legally described on Exhibit "A" and depicted on a map attached as Exhibit "B" at 7:00 P.M. on December 10, 1990, in the Chambers of the City Council of the City of Newport Beach located at 3300 Newport Boulevard, Newport Beach, California; and WHEREAS, the City Council of the City of Newport Beach desires to vacate these portions of streets and utilities easement legally described in Exhibit "A" and depicted on Exhibit "B ", the vacation to be processed pursuant to the provisions of the Street Vacation Act. NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the portions of streets and utilities easement legally described in Exhibit "A ", and depicted on the map attached as Exhibit "B" is hereby ordered vacated and abandoned. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this resolution recorded by the Orange County Recorder. Adopted this 14th day of January ,1991 . ATTEST: , CITY CLERK MAYOR C' • 0 EX.v /,B /T Im 0 That portion of Lafayette Avenue, in the City of Newport Beach, Orange County, California, more particularly described as follows: Beginning at the southwesterly corner of Lot 1 in Block.324, Lancaster's Addition to Newport Beach, as shown on a map thereof, in Book 5, Page 14 of Miscellaneous Maps, Records of said orange County; thence South 850 031 01f1 West 40.17 feet to the northeasterly corner of the land conveyed to the City of Newport Beach by Deed recorded November 1, 1922, in Book 438, Page 174, of Deeds, Records of said Orange County; thence South 000 261 25i1 West along the easterly line of Block 224, Section A, Newport Beach, as shown on a map thereof, recorded in Book 4, Page 21 of Miscellaneous Maps, Records of said Orange County a distance of 3.35 feet to the southeasterly corner of Lot 1 of said Block 224; thence North 800 201 3011 East along the easterly prolongation of the southerly line of said Lot 1 of Block 224 a distance of 40.63 feet to the Point of Beginning. That portion of 26th Street in the City of Newport Beach, Orange County, California, more particularly described as follows: Beginning at the southwesterly corner of Lot 1, Block 224 as shown on map of Section A, Newport Beach filed in Book 4, Page 21 of Miscellaneous Maps, Records of said county; thence easterly along the southerly line of said Lot 1 to the southeasterly corner of said lot; thence northerly along the easterly line of said lot a distance of 3.35 feet to a point; thence westerly in a direct line a distance of 102.22 feet to the Point of Beginning. That certain easement for reserved and described in No. 5814 recorded in Book Records, in the office of California, said certain as follows: gas, sewer and water purposes as the City of Newport Beach Resolution 7170, Page 617 through 621 of Official the Recorder of Orange County, easement is more particularly described Beginning at the southwesterly corner of Lot 1 in Block 324, Lancaster's Addition to Newport Beach, as shown on a map thereof, recorded in Boo's 5, Page 14 of Miscellaneous Maps, records of said Orange County; thence South 850 031 011, West 40.17 feet to the northeasterly corner of the land conveyed to the City of Newport. Beach by Deed recorded November I, 1922, in Book 438, Page 174, of Deeds, Records of said Orange County; thence North 000 23' 3091 East along the easterly line of Block 224, Section A, Newport Beach, as shown on a map thereof, recorded in Book 4, Page 21 of Miscellaneous Maps, Records of said Orange County, a distance of 333.48 feet to a point, said point being South 00 23' 3091 West 28.38 feet from the northeasterly corner of said Block 224; thence North 760 141 0091 East along a line parallel with and 27.52 feet southerly of the northerly line of said Block 224, a distance of 14.75 feet to the beginning of a tangent curve concave northwesterly and having a radius of 166.24 feet; thence northeasterly along said curve through an angle of 9° 211 5811, a distance of 27.18 feet to a point in the westerly line of said Block 324, said point being South 00 231 3011 West 26.09 feet from the northwesterly corner of said Block 324; thence South 00 231 1 line of said Block 324, a 3011 West along the wcsLeS_ y distance of 342.12 feet to the Point of Beginning.
