A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH SUPPORTING EFFORTS TO
PROHIBIT THE SALE OF SEXUALLY EXPLICIT
MATERIAL FROM UNSUPERVISED VENDING MACHINES IN
PUBLIC PLACES ACCESSIBLE TO MINORS.
• WHEREAS, the State Legislature has pre - empted local regulation
of the sale or display of sexually explicit material; and
WHEREAS, existing law does not prohibit the distribution of
sexually explicit material to minors through vending machines in
public places; and
WHEREAS, Assemblyman Gil Ferguson has introduced legislation
(AB184) that would make it illegal to knowingly display or sell
sexually explicit material from any unsupervised coin - operated
vending machine located in a public place from which minors are not
excluded; and
WHEREAS, AB 184 will close a loophole in the laws regulating
the distribution of sexually explicit material to minors.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Newport Beach supports AB184 and encourages all members of
the Legislature to approve legislation which makes it illegal to
sell sexually explicit material to minors through unsupervised
coin - operated vending machines in public places.
